I do not know if unemployment is considered means tested benefits. Means tested benefits can not be used as income for sponsoring.

Doing a quick search I could not find a clear answer. You may want to email/call the embassy on this one.

Means-tested public benefit means either a Federal means-tested public benefit, which is any public benefit funded in whole or in part by funds provided by the Federal Government that the Federal agency administering the Federal funds has determined to be a Federal means-tested public benefit under the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, Public Law 104-193, or a State means-tested public benefit, which is any public benefit for which no Federal funds are provided that a State, State agency, or pol itical subdivision of a State has determined to be a means-tested public benefit. No benefit shall be considered to be a means-tested public benefit if it is a benefit described in sections 401(b), 411(b), 422(b) or 423(d) of Public Law 104-193.

Timeline

Unemployment Compensation IS Countable as Income. It is not Free Benefits, it is Taxed and not Charity.

However, it is a temporary type of issuance of income as a means of searching for other employment or return to their former job as a result of a temporary lay-off.

The employer and employee paid into this fund. It is countable as income but not considered stable.

It is a source of temporary income. No it's not solid. It will be included as INCOME when the Petitioner files 2013 Taxes. Yes, temporay income. The statement will be there. It is counted as Income none-the-less but not tested means or charity. The requirements of the Petition are the same. Hopefully, the Petitioner has/or gained employment to date.

You can list it, as it is income, BUT it may not be counted and accepted for the affidavit of support since it is temporary income that cannot be relied upon and stable and ongoing.
