Hi everyone!

I'm new to the forum but i've read quite a few posts already..

This is my story:

I came to the U.S. to spend some time with my girlfriend (US citizen),we spent the holydays with her family and friends and it was great.

We had met on a criuse ship 6 months ago and since then our relationship has become really strong and we decided we want to get married and have a family here in the US!

I read a lot of posts about visa fraud and that scared me a little, i have nothing to hide about the decision we took beacause there was absolutely no planning.

We want to get married next week and start the I-485 (adjusment of status) asap beacause she is going back to work on a ship for 6 months starting on the 19th of january and i had a very good offer for a job here that is open until i get work permit.

I would like to know a little bit more from someone that went through this process, i want to apply concurrently for the following forms:

I-130 (petition for alien resident) I-485 (adjusment of status) I-765 (employment authoriztion) I-864 (affidavit of support) I-131 (travel document)

Any advice is very welcome!

If you entered without intending to adjust status and immigrate, and never lied to customs/immigration, then it shouldn't be a problem. This of course assumes you're a normal person in a normal healthy relationship. Something like a criminal history, an atypicial relationship that screams visa fraud, or being caught in a lie to immigration/customs are the things that can give you trouble.

Your wife is leaving soon. You need to start working immediately to get all the stuff required for AOS. In my experience filling out the forms isn't the hard part, it is gathering all the additional documents that may catch you due to your time-crunch. A non-exhaustive list would be:

*Your wife's 2012 tax return

*A copy of your wife's birth certificate

*Certified copy of your marriage certificate

*Any divorce documents (you or your wife), and/or any death certificates of past spouses (you or your wife)

*Evidence of a bonafide marriage

Luckily, most of these items are things people have already. But if you don't have them yet, start the process of getting them ASAP, because getting them after she is on the ship will probably be a lot more difficult.

Not sure about the birth certificate, that probably varies country by country. You can try calling the Italian consulate. Of course, a copy of the birth certificate is enough so you can just get a family member in Italy to scan it and send it over. Getting a translation may take time, but for a common language like Italian likely not difficult.

Ues, you can file for AOS ... fill out all the forms as you outlined above... have your fiance However, the birth certificate thing might be a bit of an issue... My husbands we had to go to the commune and get a copy of the long form as they were not digitized at the time... But your family can get and scan a copy, then send that copy (have it notorized at the Prefitura ) to you via mail. Depending on what port she will be out of and the cruise line, if you need things signed, you can meet her at the port... I had to do that for all kinds of stuff when my hubby was a crewmember.

You can self translate the documents... You know you cannot travel until AP / EAD combo card is received right? Before she signs on, have her gather all her documents and signatures... Auguri!

4/4/2013. : Oath! Now a U.S. citizen!

My mother just got it from the pubblic office and it has been stamped by the prefettura! Do they need to send me the original copy to attach?

You can send a copy, but have them send the original copy in case they request...

I am not 100% on the Interview process for AOS, but from everything I have seen, I believe it is at our local office... I am sure someone will chime in here... Good luck

They will send you your biometrics and interview letters with the locations for you to go to. They use your nearest field office. You can look up yours here > http://www.uscis.gov/about-us/find-uscis-office/field-offices
