Hello. I have just arrived here in the US and my wife and I are preparing my Adjustment of Status papers to file. We have a couple of questions we hope you can help us with...

1) The I-485 asks for a social security number and a A number. Can I apply for a ss number before filing for AOS? Which number is the A number?? there is a red number on my visa in the annotations section, and a really long line of numbers also on bottom and also a "control number"?? Which one??

2) We saw another members timeline, they did not file for a adjustment of status until the 2 years on the visa were almost expired..? We were under the impression that we had to file for AOS as soon as I arrived in the US? Do we have longer??

3) We have read conflicting information about working. I am here on a K3 Visa, can I work or must I wait to recieve permission?? Same confusion about traveling...I was told when I enter the US on a K3 I can immediatly travel if I need to and reenter the US but I see the form for permission to travel before being granted the green card?

Thanks for all your help!

1) On K-3 visa you will need either Green card or EAD card in order to apply for SS number.

2) You can adjust status any time up to the expiration date on I-94, even a bit after, but you will be out of status and it would not be advisable to be out of status long. Some wait until after they did a more favorable tax return to use the better return with the I-864.

3) In order to work you need permission from the USCIS, you apply for EAD card, using I-765

Thanks for your help! Can we apply for EAD only now and get a ss number and then several months from now when we can afford the fees apply for the Adjustment of status then?? Do they need to be filed together?

In the WAD guide on VJ under K-3
1. While holding a valid K-3 (not yet applied for AOS). As a valid K-3 visa holder you may apply for an EAD based solely on this status. You will apply as a category (a)(9), K3 non-immigrant spouse. (Where: by mail -- to Chicago ONLY; not to your local office)

Yes you can apply for EAD before adjusting status.

easycome00,

1) Any information that the I-485 asks for, but does not exist, means that the answer is 'none'. None of the numbers that you describe is your A#. An A# starts with the letter 'A'. Look on your I-94 or on the Approval Notices for your wife's petitions. Others have addressed the SSN issue.

2) You have until you die, at which point it becomes a moot issue, but why wait that long? The sooner the better, when your I-94 expires at the latest, unless you're willing to spend your life living in fear of ICE.

3) You need employment authorization to work. You can travel abroad whenever you want but you can return only with a valid visa in your passport.

easycome00,

Indeed, it is to a K3's benefit to apply for EA prior to applying for adjustment - you get more for your money that way.

Why would you want to delay the process for your greencard? Sometimes these things take ages - sometimes your process goes smoothly.

Personally I don't think being pinched for cash is a good excuse to delay the petition. Eat beans for a month.

Do you have an easy answer for if we were eating beans to begin with???

Its been a long road for us to get him here to begin with (we were married in September of 2005) so yes we know these things can take a while. Of course we are not purposely waiting you have misunderstood our intent with the questions, we only want to know our options and yes if getting him (I'm easycome00's wife) his work authorization FIRST so we have more income to pay the fees helps then who are you to tell me what is a good excuse and what isnt?? I obviously want more than anything to have my husband here and permanently or I wouldnt have gotten myself into this financial mess to bring him here so please dont tell me what is acceptable.

Apply for your EAD as soon as you can and don't worry about the AOS application until you can afford it. If you don't have your interview until after your second wedding anniversary, you will not have to get a conditional green card and then go through lifting of conditions. So it may be to your benefit to wait 6 months or so to apply for it anyways. If I were in your situation, that's what I would do.

You misunderstand my point. Look at our timeline. You will see that my husband's Adjustment of Status has been held up in FBI namecheck. We filed his adjustment nearly 14 months ago and there is no end in sight for us. Indeed, we have had to pay for a second EAD in order for him to continue working.

I don't mean to come off harsh. We too are pinched for cash. I simply wouldn't want you to find yourself in our situation. It's best to begin the process and get immigration off your back. There's a lot more to Adjustment of Status than one's ability to work and earn income. Your husband isn't even afforded the protections that the US Constitution affords us all until his status has been adjusted. Why would you want to delay that?

PS - We eat beans too.
