Timeline

i'm a US citizen, my fiancee' is an Australian

citizen. We plan to get married and her move

here and become a US citizen.

We had planned on getting married in

Fiji but it looks like this would add unnecessary

complications.

Any advice or suggestions on the smoothest

path to our goal ?

Get married wherever you want- it's fine to get married in Fiji, she can still attend interview in whichever country she is currently legally resident in.

BTW, just a note on terminology- first, you will petition her, then she applies for a visa, later she gets a visa and only several years down the line can she apply for naturalisation to become a US citizen.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

It depends on what you consider "better". Which is better: bring her here to the US as a fiancee on a K-1 visa, or bring her here to the US as a spouse on a CR-1 visa?

Do you want her to be able to work right away? Do you want to be with her in the US the quickest? Do you want to spend the least amount of money on the process? Here is a quick rundown of the differences between the 2:

K-1 (fiance) Visa:

  • Usually much quicker than CR-1. You can be together quicker usually.
  • Costs a bit more than CR-1.
  • Your fiance cannot work immediately, will usually have to wait 2 to 3 months AFTER you file adjustment of status
  • You still need to file adjustment of status after she comes here

CR-1 (spouse) Visa:

  • Usually takes a while to process. You will be married living apart for a long while.
  • Is cheaper than the K-1.
  • Your spouse will pretty much be able to work right away.
  • You do not need to file any more paperwork for about 2 years, she will receive her green card shortly after arrival.

Thank you all. For us i think the IR-1/CR-1 is the way to go.

There are commitments there that will not let her move here

for 18-24 months anyway. She very much wants to be able to

work as soon as possible after her arrival.

Current plan, get married in Fiji in September, then back to

the US for me and Australia for her.

Does anyone here have personal experience of

marrying in a 3rd country and then getting their

spouse here ?

Ideally an Australian and a US citizen. My

fiancee' and i are getting conflicting information.

Some say that USCIS looks askance at 3rd

country marriages and that doing so will make

our journey more difficult.

If that has been part of your journey please

tell me about it.

Marrying in a third country makes no difference. If you are reading that, you might be reading extremely outdated information about a K-3 visa, an obsolete type.
