Time span for bringing children under 21 to the US

Thank you...if the child is 20 when the petition is filed, will that affect his chances. Because he will turn 21 during the process.

Turning 21 will affect the petition.

CSPA freezes a family preference beneficiary when the PD becomes current.

When the child turns 21, it goes from an F2a case to an F2b case.

Whether CSPA will help depends on how close the child is to 21 and how long it will take for an available visa number after the I-130 is approved.

There is no way to predict if CSPA will help.

How many more months until the beneficiary turns 21?

When the petition is filed, The child will be 20. It will be a full year before he turns 21. I am speaking in future because my mom will be the one doing the petition when she gets here next year hopefully. I am just trying to plan everything for her so she knows what to expect.

you have no way of knowing how long it will take your mom to come and when she files for him if he is already 21. too far away to know what will happen

There is no guarantee that CSPA will help.

Let your mother know that her child will age out from the F2a to the F2b category when he turns 21, and there is no way to know if CSPA will help him until the PD becomes current in the F2a category.

Right Now, About One Year.

Ok thank you so much. Really appreciate the rapid responses. How soon can my mom file the petition for my siblings when she gets here?

True she can the same day she entered the US.. I would suggest waiting about least 1-2 weeks to allow the info to be entered so that when USCIS goes to validate her info its there and have no delays.
