K1 - VISA approved but 221g

Timeline

Hi, my fiance had her interview on January 7th and all wen well except we were given a 221g in regards to our NBI clearance. She had one issued in July of 2013, but the embassy wants something more recent. The embassy instructed her to do nothing and the passport with visa should be ready in less than three weeks. Has anyone else encountered this situation? My fiancee is from Leyte and has been displaced since the typhoon. This is truly a burden. Any idea how long this could take?

I am not sure what's the processing of NBI Clearance in Leyte but in my city i have to get an appointment and come back on the date that is given and fill up the form, pay, picture, finger printing and signature.. it usually takes 10-15 days once you get a schedule and you can get your NBI Clearance immediately if there's no Hit! Tell us about your fiance's interview at the embassy, we wanna know it :)

7-25-2014 - Sent off the packet I-485 && I-765

7-29-2014 - Recieved NOA's

8-25-2014 - Appointment letter Received (Biometrics) Dated for 8/29/14

8-27-2014 - Early Walk-in SUCCESSFUL!

10-3-2014 - EAD CARD PRODUCTION!!

10-9-2014 - EAD has been Mailed - IN TRANSIT!

10-11-2014 - EAD Received!! :)

Depending on each NBI location, normally you can get the clearance in the same day if you visit the office in the early morning then pickup can be accomplished by the afternoon. But if you are depending on the Embassy to secure a new NBI then it will take additional time. The USEM and the NBI have schedule sending/return dates. Usually the weeks worth of requests are sent on Friday from USEM to NBI. So one week to NBI, one week to return to USEM and within a week for it to be touched by USEM for final visa processing.

This is what we experienced with a 221g on a NBI back in November. Your experience my vary.

TD May 23, 2014 Travel Document approved and went for card production

Receipt EAD/AP May 30, 2014 Received combo card EAD/AP

Green Card Approved July 11, 2014 Approved, no interview. Went to card production.

Green Card received July 17, 2014 GC received without interview

Removal of Conditions

Mailed I-751 Dec 16, 2015 Submitted ROC (removal of conditions)

Received Dec 18, 2015 USPS notification of successful delivery

Check Cashed Dec 21, 2015 Check was cashed

NOA-1 Issued Dec 21, 2015 NOA-1 for ROC issued

NOA-1 Issued Dec 26, 2015 NOA-1 Received

Biometrics Appt. Jan 29, 2016 Biometrics Appointment Scheduled [Completed]

The embassy doesn't like for the NBI to be over 6 months old. The 221g didn't instruction her to order a new NBI (normally she would order a new one, then NBI would deliver it to the embassy)? Interesting. The embassy apparently is going to handle this for her... that is sort of different.

There have been other cases here on VJ where the USEM ordered updated NBI clearances for the beneficiary. If I remember correctly, those cases were resolved in less than one month.

Also, sometimes the Embassy will order another NBI clearance for a much more recent clearance which was submitted by the beneficiary at their interview.

Thanks for the responses. The embassy is contacting NBI to address the situation. The interview went fine. We were well prepared except our NBI was 6 months old. Hopefully this will be resolved quickly.
