GERMANY: name change, new documents, same sex marriage...set up for desaster?

Timeline

hey everybody,

so my fiance and I are getting married in a few weeks. Currently my name is straight forward: First Name and Last Name. We decided to have the same last name, but I am not willing to give up my maiden name completely. So my new name will look like this: First Name/ maiden name (now middle name)/ New Last Name. Pretty standard in the US, right?

If I wanted to change my name in my German documents, would they accept all three names? Surely my first and new last name, but what about my maiden name being now my middle name. I guess that would be considered my 2. Vorname? But is that even legal in Germany?

To make things more complicated: We are a same sex couple. Same sex marriage is illegal in Germany. Would they accept our marriage to get my name changed and could we register our marriage in Germany as well??

So many questions. Found some things regarding name change online, but the same sex thing adds a whole other dimension to this already complicated matter.

Goldfee11: civil unions are not the same as marriages in the eye of the law. http://en.wikipedia.org/wiki/Recognition_of_same-sex_unions_in_Germany "Illegal" is maybe not quite the right word, but Eingetragene Lebenspartnerschaften do not have all the same rights as a regular marriage, sadly.

Unfortunately I have no advice for the original query, but I wish you all the best in sorting it out!

ROC filed December 3, 2015, NOA1 12/4/15, Biometrics 12/31/15, ROC Approval on June 16, 2016, 10-Year Green Card received June 22, 2016.

N400 filed September 14, 2023, same day acceptance and Biometric Reuse notice, Interview on 2/13/24: Passed and same day oath. ALL DONE WITH USCIS.

2024 February 13: naturalization interview (five-year rule) passed, same day oath - now a US Citizen and done with USCIS!

I am a USC and my same-sex partner is Spanish....we currently live together in Germany. Last year we had our civil union in Germany, and at that time we were given the option of changing our names. We weren't interested in doing so, which means I can't really offer insight regarding whether or not your proposal would work (sorry). My only input is that our German friends said that changing it at that time was the most painless way to do it -- maybe the two of you could/should get your civil union in Germany first? It served us quite well as proof of ongoing relationship :) Plus it was good for out tax bill dancin5hr.gif

thank you for your take on this, in the meantime my husband and i got married here in the states and i'm in the AOS process. i conversed with germany and they signaled that they will NOT accept my new name. my old maiden name is now my middle name and since they don't have middle names in germany it would still be my last name. it's backwards. they rather want me to have to different names in two different countries. oh and we can not register our marriage in germany, it would be downgraded to a civil union. i'm simply refusing to do that. once germany has same sex marriage, i might register it. for now: there is really no reason. we are living in the us and are getting tax breaks here.
