Fiance Visa while outside of America?

Hi everyone,

My American fiance has been living with me in Australia for almost 2 years. We have decided that we want to permanently move to America - she's from Minnesota.

We've just started looking through the documents for the fiance visa and have some questions I'm hoping someone can help with:

1. Can we apply for the visa while she's living in Australia, or does she need to travel back to the States?

2. We've noticed there is a section where she needs to provide proof of financial support. She's currently working fulltime in Australia, but does anyone know how this works for the visa? Does she need to be working in the States to satisfy this section?

I am in Singapore with no plan to move to the USA. I filed an i129F for my Myanmar fiance. The reason for a K1, is becuase it is difficult for her to get a B2 if you are from Myanmar.

The petition is approved, but not done procecessing.

I drew funds on a US bank to pay the fee. I mailed the paperwork from the USA during a vistit.

What will happen going forward, is unknown. The challenge ahead is the fact that I have no USA income.

I suggest you get a USA bank account and put as much money in it as you can. Also ask your future in-laws to co-sponsor.

If she goes back to the USA ahead of time to get a flat, and a job that might help at lot. Beware the economy is soft. I wish I could trade places with you and move to Aus.

2013 01 01 Started cohabiting, and obtained a joint bank account
2013 07 13 Engagement
2013 10 11 Sent i129F to USCIS
2013 10 18 Received NOA1 from USCIS
2013 11 12 Received RFE notice - Almost decided to change the venue to Thailand. Sat on the RFE for about three weeks before proceeding.2013 12 20 RFE answer package received by USCIS
2013 12 23 NOA2 received from USCIS
2014 01 14 After demonstrating the hate Americans have tward the chidfree, my fiancé has no desire to visit the USA.

Going forward, I will sell off my remaining assets in the USA. I doubt I will ever return. Americans are second only to the French when it comes to rudeness.

Oh, I did disclose that I live in Singapore. The i129F allows you to specify a different mailing address from your residence. I listed my Singapore residence, and a mailing address in the USA.

You can file while still living abroad. When it comes time for the K-1 interview, you will need the I-134 and financial documents. The Australian job will not count for the affidavit of support. She will need a job in the US already, or a co-sponsor. If using assets alone drawn from a US bank, you need 3-5 times the amount needed for income.

1)You can apply from abroad no problem ,thats making it easy to prove the meeting within 2 years requirement ;-)

2) an income is needed from US (125% poverty level), co-sponsor or assets as mentioned by Jay-Kay.

Thanks for the replies!

This is what we expected but just wanted to double check. Her sister can co-sponsor, she currently makes about $45-50k a year so I believe this is sufficient? We really don't want her to have to move to America before me to work.
