k1 visa reissuance/renewal/revalidation

its a complicated situation hope I get some ideas and help from here,had interview on 10th of December 2013......and it was approved,travelled to the US on 22nd December 2013.....and left the US on 1st january2014 due to a family emergency could have waited but it was urgent plus on the second there was going to be a big winter storm which claimed several lives.......my fiancé was afraid and had me catch the next available flight home.......now the situation is stable and I need to go back to my baby.....but we are okay if we will be forced to start all over again.....our 90 days since my first admission to the US are still available,plenty of them.....we have contacted our lawyer and she didn't help much she told us what we already knew.....on the CSC Kenya ,it says to follow the normal procedure of visa application,are there any extraordinary forms that we have to fill? all we. know is that we have to pay another visa application fee? anything else........please help...

Well, ny friend if you want enter tu usa again , there are diferents form that you can fill out.

You can fill out a I-129f again or a I-130.

With a k1 you cant leave from usa without AOS.

For leave the country without GC, tou need fill out the AOS and leave with an AP, AP is a form that permit you travel without GC

I wish good lucky starting this process again.

I dont know your emergency but after this long process you shouldnt leave the country withou AOS..

You know better the rules for K1,

It is a visa to enter one time to usa.

If you have not married yet, it could be possible to get the K-1 reissued. You would need to still get married within the original 90 days of her entry though.

9 FAM 41.81 N6.3 Reissuance of K-1 Visa
(CT:VISA-1547; 09-27-2010)
If a K-1 visa, valid for a single entry and a 6-month period, has already been used for admission into the United States and the alien fiancé(e) has returned abroad prior to the marriage, the consular officer may issue a new K visa, provided that the period of validity does not exceed the 90th day after the date of initial admission of the alien on the original K visa, provided the alien fiancé(e) pays a new application processing fee, and provided also that the petitioner and beneficiary still intend and are free to marry. The alien’s return to the United States and marriage to the petitioner must take place within 90 days from the date of the original admission into the United States in K status.

Contact the embassy about it. You will need to pay the visa processing fee again.

The 90 days are only for get marry at usa, no for leave and entervagain.

And yes you need start the process and pay again.

you seem to not have understood my post but thanks for the information and we know we might be reissued or not so either way we will follow what the embassy will decide

there are some emergencies we never plan for only Gid knows why some things happen the way they do ... .I understand how long the process is been there.....and if we have to again I don't mind only God knows why

and for your information there is something called visa reissuance/ revalidation we want to they that just that we don't know what forms to fill

- Denied March 13, 2012

- Placed in AP March 14,2012

- Sent back to USCIS November 2012

- Expired March 2013

WASTED A YEAR FIGHTING THE DENIEL

MARRIED MARCH 15, 2013

1-130 Approved 3/3/2014 :-)

Finally made it home 3/18/2014

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
