Approved 130, Next step?

So my mom concurrently filed AOS package for me as a PR in oct 2012 while i was in the states, not knowing at the time that she would have to be a us Citizen to do it that way. Long story short the 485 application was denied but the 130 was approved & the officer told us that our PD would be current starting sept of last year i believe for my category , & that we should just re file 485 since we have the approved 130.. What i'd like to know is, Is that all there is to it? Would a waiver have to be involved since im now considered overstay ? My PD is Oct 18 2012.. Any details on the process and what should be our next step would be greatly appreciated.. Im considered unmarried child under 21 of PR . Thank you !

if you are IN the USA, and you think yer PD is current, by all means file the I-485 again.

if you've not left the USA, the waiver is not needed.

Thanks so much for replying Darnell, I am in the US but i would now be considered overstay since the time my application was filed & denied exceeds my six months ( I entered on B2 ) , Would I not need to overcome that ?

ya, sorry, i keep forgetting PR stuff, apologies.

for that type, you'd need a waiver and I've no clue on that process.
