As my fiance and I are planning to get married in April in India. He was denied his K-1 visa due to CO not convinced of relationship. To me this sounds like we did not provide good enough evidence or something went horribly wrong at the interview. My fiance went though all the questions with me with his answers and every answer was truthful and sounded good to me. Now my confusion is wondering the "not convinced of relationship" decision, does this mean she thinks this is not a bonafide relationship, a fraud relationship, or is it what I think we just did not provide good enough evidence . I been having a hard time finding the answers. I contacted my senator but they given me the same answer of CO not convinced of relationship and not reason why she thought this. I need to clear this up before I file for a CR-1 visa for him and also what I need to do to provide better evidence also. I feel so lost and confused and I also dont know how to tackle my red flags because how to you solve for past divorce, with kids and being 5 years older and different religion ( actually I can solve this by just "converting" to Hinduism ).

Did you front-load your petition meaning what evidence did you submit with your I-129F?

Many K-1 couples don't submit much but the required "Letters of intent" saving the evidence for interview. Well for many of us going through tough embassies that is not good enough. Imagine the CO got all your petition package.What was in it to convince them you were really in love and all that? At interview is way too late to submit bonafide relationship stuff, (i.e. chats, IM's Skype, phone log, text, emails, letters cards, affidavits, pics) for some of us. You have at best 10 to 20 minutes with CO they may or may not even look at what you brought.

Although getting married isn't a guarantee to an approval it most defiantly shows the bonafide of a relationship and the seriousiness of it.

My take on K1's is this, something I have followed closely for Lagos. I don't know your age but you say you are divorced with kids so I can assume you are mature woman here (ie. over 35 I imagine) so really a K1 isn't for you. Cuz really you are showing you aren't sure, undecided. I know I know you want him to come here meet the family the kids and get married. But to immigration that translate to "i want him to come meet my kids and if they don't like him the wedding is off". You have to think like a CO not like a person who loves their hunnie. I know of someone who was denied a K1 for that very reason he said at interview he wanted to meet the kids and they get married and the CO said "then you aren't sure this will go through". Denied. They married and all is fine now.

Don't sit around and second guess. You have gone over all the questions you said with your guy right? Was there any subject the CO focused in on? That might be a reason. If you two don't have skeletons in the closet and all is legit and fine then just error on the side you didn't prepare a convincing petition or the CO was having a bad hair day (unlikely but who knows).

Get married refile.

No I did not front load the petition. I filed this petition before I joined vj and I read about this. My fiance did tell me that they did look at our evidence and my resent trip to India in Nov. He told me there was slot of questions about my ex husband and he was feeling uneasy about these question due to the fact of my abuse that was done to me. As for the k1....we decided to marry in Usa because I wanted to get married in the rocky mountains.....but I think this will have to wait for maybe a renewal of vows.

Oh the dreaded ex-spouse questions to make the current uneasy. See it happen too much. Well good I think you have it.

I know it seems crazy but everyone I have seen that gets married after a denied K1 gets approved. I call it a marinating period the CO wants to see. Like "if they are real they will come back". You know some don't make it after a denial. They break up fight whatever. So just showing up at interview shows the CO "well now what ya got to say". Sorry not trying to make light of your situation but just showing you there is hope.

I would say not to worry too much about the age gap, divorce, kids, religion stuff....I am 7 years older than my hubby, divorced with 2 kids from my first marriage, he is hindu and i am christian. I think you need to show more evidence. For us, I submitted out joint bank accounts, joint phone bills, joint rental agreement in addition to all our pictures and trips together, our marriage certificate and pics from our marriage (temple and court). We are still waiting for NOA2 on our I130.

Is there anyway you can go to india and get married and show more proof of relationship? I think that once you are married and submit the I130 and all the evidence you should be fine!

Yes there is away to get married in India but I am trying to figure which is the best route for us special marriage act or Hindu marriage act. I want to show that yes we are serious about our relationship so trying to figure out things so I can fix this :)

we got married under the special marriage act. We had the court marriage at noon and then we did have a hindu temple marriage later that night so both "marriages" were the same day (the legal court one and the traditional hindu one). Honestly it was really easy, just had to give them copies of my passport, some small passport size photographs of me and hubby (they actually afix the photos to your marriage certificate so make sure its a good one!) and I also carried my birth certificate and pan card.
