Hello VJ,

Just need a help for my friend, both of them the guy and the lady are from Philippines. And the guy just got migrate in US and they are on a K1 process now. The guy just got a job last June 2013. They filed the I-129F October 2013 and approved.

Questions:

1. Since he is new in US and still don't have Internal Tax Return, Is it ok he will only provide the employment certificate, pay stubs and bank statements?

2. What are the requirements for co-sponsor?

3. Is it ok to have a 2 co-sponsor?

4. Is it ok the co-sponsor is living in a different state? like the co-sponsor is from California and the petitioner is from New Jersey.

Hoping to share your experienced and knowledge we will really gonna appreciate it. Thank you.

Well, The 129-F was Approved and thats a good start.

The Tax Return for 2013 will be available at the time of the Interview would'nt you think?

Why the question about Co-Sponsor? Is the Petitioner below levels.

Co-Sponsors on a K-1 are rare for the Philippines but can happen but I never heard of a 2nd Co-Sponsor.

Your Friend(s) should keep every Pay-Stub and copy it. Hopefully, that will meet the Petition Poverty Lines.

It does not matter if the Co-Sponsor is from a different State but remember on a K-1 Visa Petition they don't want to see a Co-Sponsor Petition and that is at their descression.

Slow down young lady. No one has really gotten a Tax Return for 2013 as of yet or filed.

That will come shortly.

May I ask: What is his wage? Is he Full-time. Is he Temporary or Permanent on the job... There you will find if he meets they meet the Petition Requirements at the time of the Interview.

And yes, he will have a Tax Return after he files. His job will send him paperwork and he will file.

2. The requirements are the same as a normal sponsor, except they will have to provide proof of either US citizenship or LPR status

3. No, there is only one co-sponsor.

4. The co-sponsor can live anywhere in the US, however the Philippines is very picky about who they will allow to be a co-sponsor if they will allow one at all.

The only required documents for the I-134 co-sponsor is the Form I-134 with original signature, most recent tax return, and proof of citizenship or LPR status. The employment letter, paystubs, bank letter, etc...these are all optional. Include only those which will help your case. For example, if your income is sufficient you don't need to include a letter from the bank. The employer letter and recent pay stubs will also further help your case and it is recommended to include them...however they are not absolutely required.

Co- sponsor is rarely accepted in the Philippines (Manila US Embassy)

If you're fiancé started working last June 2013, Have him file his 2013 tax return as soon as he gets his W2 by the end of this month or early february.

If his income going forward 2014 is enough to satisfy 2013 Federal Poverty Lines, You guys should be OK.( Just bring proofs: Employment letter, pay stubs). Otherwise, there will be a problem sad.png and you need to marry and file I-130 petition for you and start all over again sad.png.

With I-130, Co-sponsors are accepted in the US Embassy in Manila, Philippines.

Just last question.. They decided that there co-sponsor will be the cousin of the father's beneficiary... Its it really required that they shoud have the same surname?

And other thing just in case.. Is a friend or not relatives of the petitioner like his manager.. Is it allowed to be a co-sponsor?
