Pre-EAD Work authorization for K1 Holders? JFK?

Hi everyone,

I'm trying to pin down exactly what is the deal with a temporary work authorization for K1 visa holders. I've learned a lot on these forums, but I'm still not clear on the details.

Several people have posted that you can come in, wait 10 days, and then apply for a social security number, with which you can work for as long as your K1 is valid (90 days). (is this 10 business days or 10 regular days?)

Others have talked about getting a work authorization stamp on your 1-94 when you come in on the K1 visa, and a couple of people have mentioned that they only give these stamps at certain POEs (like JFK airport?).

Lots of people agree that its a great idea to get married right away and file the EAD + AOS, but that the EAD takes 2-3 months to come through.

Does anyone have any information on this?

Hey Emma ! I've dissected yer post a bit.... Here we go !

1. Them folk are stoned , wouldn't rely on their answers, if the summation of what you wrote is covered in bit #1. The bit in bold is the problem, as a K-1 visa holder without a green card, cannot work without BOTH an EAD and a SSN

2. If any POE still does this, it's a nice loophole, but the CBP staff know not to use that stamp anymore. Get that stamp? You ran across a CBP goon, newly hired, short on training, that somehow got to work that day without the shift supervisor giving the daily briefing, and somehow got access to the deprecated EAD stamps in the locked closet.

3. For 2014, this is the way you should roll.

A few years back, we had heated debates about an EAD stamp - you can find them with the advanced search tool here.

search terms = 'EAD STAMP jfk'

then click on 'display as posts'

You cannot work with just the SSN. You must have an SSN and the EAD or green card. You need both, not one or the other.

There is no stamp given to a K-1 entrant that is valid for work, even at JFK.

When you file for AOS, you will file for the EAD (and AP) at the same time. It takes 2-3 months from filing to receive the EAD/AP.

If working right away after entering the US was extremely important for you, then the K-1 was not the way to go. A K-1 entrant cannot work right after entry There is a gap of a few months. Getting married first and applying for a CR-1 would have been the way to go if working right away was needed. Someone entering with a CR-1 becomes a permanent resident upon entry and can work(after getting SSN) and travel and re-enter when needed.
