hi everyone! Can someone help me here....

My boyfriend only have his 2012 w2 and tax return but its only 6 thousand so we cant use it because its below poverty level.... But last 2013 he made almost 20+++ but we don't have his 2013 tax return yet.... We only have his Pay Lists that states how much did he earn on his regular job for 2013 and firecheck list since its his 2nd job.....

2nd, his dad is our co sponsor but he provide us us his affidavit of support, how much he had at the bank and 2012 tax return..... no employment letter or w2 or paystubs......

What should I do? Is this okay now or not really? please help!

Please update your time line. Where are you at in the process? Did you just send it? Did you get the noa2? Waiting for the interview? Manila hardly ever accepts co sponsors. You might have to wait until your fiance can do his 2013 taxes. Please update us with where you are at in the process.

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

im going to have my interview nextweek. Im thinking of canceling our petition coz the petitioner dont even give effort with our papers.... im so sad right now but i think thats the best I can do. im so stress out for months asking him for the papers but he dont listen to me..... i had enough with him....

hi everyone! I just want to ask some help about our status.... Im sorry i don't have a timeline but I'm going to have my interview nextweek.... the problem is we lack w2 and tax returns from petitioner and cosponsor. He lost our noa2. no paystubs sent to me..... lack of employment letter. we only have a list on how much he earned last 2013 from both of his job..... It's been months and I'm reminding him everyday about the papers but until now he haven't completed it yet.... we will just end up fighting at the end of the day.... He is really hard headed, he don't listen on what we need. he is lazy to complete the papers.... Im so frustrated right now and sad, but I think canceling the petition will be the best way so i can be stress free..... Cause i know if he is really willing to marry me, he will do everything but it seems that he is tired processing the papers.... What should i do?

I am sorry you are going through all this. I just read a previous post from you about your ages. Did either of you just finish university? If so you might be able to get a co sponsor depending on how your bring it up with the CO. Someone from the Philippines who has gone through this might be able to better assist you. I know there has been a few people who have had co sponsors for a K1 there. You might want to see if you can postpone your interview for a month or two for your fiance to get his 2013 taxes done. Good luck.

are taxes or w2 really that important? We also have his pay list that states how much he earned last 2013..... its like a summary of his paychecks...... Im so stress out right now..... I finish university but my fiancee havent went to college yet..... It seems that im he only one moving for the processing of papers...... Im so sad and frustated right now...... i dont want to cancel my interview next week but Im thinking i want to camcel the whole petition right now......

we have been together for almost 1 year six months..... Ive been to us for a year when i met him and he visited me twice here..... I gave up everything for him, i didn't work my profession just to spend time and talk to him everyday cause of our time difference..... I told him to cancel it, but he wouldn't..... He told me he will work for it but I had enough of him.

question:

is tax return really that important? or pay list for the year that states how much he earn will suffice?

He needs to submit his tax return or something that could proof that he has job/have pay/have money. You cannot just handwritten it or have it type and printed out without signature/notarized.

If you cancel your petition, you need to start from scratch again. You can postpone the interview while both of you sort out if you really want to continue or not. That will buy you some time since the petition can be extended up to a year.

he dont have tax return but he have a proof that he is making more than enough.....

Its a check history report. It shows that he made 20000+ $ on his regular job and 9000+ on his second job..... its shows his gross wages, federal tax, med tax, deductions, benefits and net wages.....

you can go on with the interview but in the end you will be given a 221g ..u can submit the documents needed after the interview, you will be given 1 year to comply for it:)

Yes, the 2012 ITR is that important.

Also, Philippines is really hard on co-sponsors. More are denied than accepted.

My question is why is your petitioner making such a small amount of money?

If he is evading sending these documents, there is a reason why.

Unlike others above, go to the interview. You may /maynot be approved. Take the previous year ITR and the current year pay check stubs along with letter issued by employer. It may just work. I have read cases where it did.

The worse thing that could happen is you get a 221G because of it. Then you will have to submit the MISSING documents, but at least the interview is out of the way.

Now a reality check:

1) Are you award that it is EXTREAMLY hard to live on $20,000.00 / year in the United States?

2) You mentioned he does not have an education. Like the Philippines, it is very very HARD to get good paying salaries in the U.S. without an education.

3) When you arrive, you are not allowed to file for social services for aide. If you file, your I-864 sponsors will have to pay it back. ( although, rarly enforced)

4) His reluctance in sending you the required documents should be of MAJOR concern to you.

In closing, my prayers and luck to you. Walk with open eyes and realisitic expectations. Be cautious.

Please keep in mind that some dates are only known after receipt of another document.
For example, the USPS Form 3811. The stamped receiving date was not know until the original Form 3811 was received on 07/13/2013 1:30 p/m CST.

I'm confusing. You said have had enough of him but still want to continue the process. I know difference time for both of you is really eat out energy. No difference as many people here on VJ dealing with that situation-including me-. That always has been said here over and over again do not give up everything before visa on hand.

So, here my question, are you really wanted to continue the process with all troubles ahead of your coming up interview? If yes, so, just prepare all financial supports that you have now and be aware when they asked you many questions regarding I-134.

Remember consular officers are well trained to see things differently and they could ask you why the petitioner is not provided it and eventually push you to talk about your relationship is heat on and lead you to denial. Relationship is exist when a team of 2 persons working together to make it happens. Good luck for any path you'll choose.
