It is up to the govt to prove fraud... However she entered on a student visa before knowing you, so,she obviously did not enter the USA for the sole purpose of marrying and adjusting status... It will not even raise an eyebrow. As long as you have a bonified relationship, no problems. Fraus come in when people enter with a tourist visa for the sole purpose of adjusting status. What you are doing and her staying seems very legit and should not cause any issues. I vote AOS... Good luck...

Yes i agree with u guys ..one last thing if i already file my n400 application as divorced which i did and submuted do u guys think if i get married now and tell the officer that my status had changed..What possibly gonna happen?

Just to let you know I have no clue how Ukraine came into my last answer lol. That was my auto correct in my phone, sometimes I feel like it is an auto make it wrong. But I would suspect that doing that will make a delay in your application. I believe I've seen somebody who has done that and they got delayed because of that. I can't remember the name of who had to go through that.
