They will want your tax return to see your income. I don't know if they will make an issue out of the erroneous filing status. If your income is sufficient to satisfy them as far as your being able to support the both of you, then it shouldn't make a difference. But be prepared to explain to them that you intend to file an amended return after your husband arrives. This is the type of issue that can be completely overlooked, or it can take on a life of its own. So just proceed normally and deal with it as it comes....

sorry but if you were married in 2012, irregardless of where your husband is... you are MARRIED! how can you file single ? unless you didnt tell the tax preparer, then thats your fault, otherwise you need to seek tax help elsewhere.

please wait to see what others here say, but i believe this could be an issue for AOS, since they look at your tax transcripts and it will say that you were single for 2012, when infact your marraige certificate will say 2012.... so you would need to ammend your tax return...

3 years before when I called IRS to ask what should be my filing status if my wife is outside US and never been to US and do not have any US visa, I was told to file as single or married filing separately. However, to use tax document as an evidence of relationship, I filed MFS.
