Can I submit the AOS and EAD I 765 without the I 131?

We are not planning to leave the country soon. Can I file it with EAD but no I 131? If so, will there be an extra charge?

You can but why would you want to? It takes just a few minutes to fill out the I-131, and it doesn't cost anything. Its better to have it and not need it, than for something to come up and you need it but don't have it.

Just do the I131 anyway, cost nothing extra apart from another set of photos and a little time. Then you have it just in case.

I echo the other posters. Apply for it anyway. We have posters on here every other week asking for help because they did not apply for an I-131 and then have a family emergency in their home country come up.

That is one big reason why most VJ folks and the Guides suggest that you apply for EAD and AP along with your AOS app.

If I'm going to fill up I 131, what should I fill for part 3 to 7? We don't plan to travel or when to travel at all. Help me.

Parts 4, 5 and 6 you leave blank. On part 3, just put in a date in the future for intended departure date, and put something like 2 or 3 weeks for length of trip. On part 7, you just need to answer the 1st question...and just say More than one trip.

The form is short and easy to fill out. No explanation statement is required when filed with a pending I-485 and you can simply leave the dates and length of trip blank, then hand-write in Unknown after printing it out.

Just put in "Unknown" for date and length of trip. No need for an explanation letter either if you are filing with an I-485 (from your other posts, I see your wife came on a K1 visa). As for the supporting documents, see the instructions on the USCIS website. It really is no biggie.

Please complete the 131. I stupidly did not do so and my husband's mother became seriously ill and he LEFT the country without permission. We are now in a terrible predicament. Please learn from our bad choices/experience and fill out that 131!! One never knows what emergencies may come up.
