Can I file I-130 in New Delhi India for my spouse?

Hello,

I am new to this forum. I am going india to get married over there. Planning to stay there for 60 days. Need help with visa question I have.

1. Can I file I-130 in india so I can bring my new wife with me. I am planning to stay there for 2 month but I hear that If I am there for 90 day I can file it over there. I need to know what is the common ground rules to file I-130 in india.

2. What Kind of process is best if I am filling from USA? I read K1 , K3 and IR1/CR1 process but it confuse me more so someone can guide me which path I can choose to start the process. I want to bring my spuse ASAP but I am ok if I have to wait.

you have to live in India for more than 6 months to do DCF I believe. If you are marrying her in India you can not to K1 as that is for fiance. You will have to do the I130/IR1 route. Are you traveling there on a PIO or a visa? That might play into whether or not you can do DCF.

Well one there's no ASAP bringing over on a CR1/IR1. You are looking at 12 to 16 months time from USCIS to interview.

K1 only applies to engaged people.

K3 although still on the books to file is rarely if ever issued because once the I-129F is sent in they send it to where your I-130 and they get adjudicated together. So it nullifies the I-129F because ther is a approved I-130 on the books so no need for a K3.

If you marry you will file I-130, which will later be a CR1 Visa application fo you. You can not file in India you are not a resident and do not meet the requirement. You have to file in US either mail it in while you are still in India to not lose time to the Chicago Lockbox or you mail in when you get back to US.

I have PIO card and I can stay up to 6 months with PIO card.

yeah the problem is if you stay more than 6 months you have to do the FRRO registration and to do ANY DCF you have to submit the FRRO registration papers. So unless you plan on living there for at minimum 1 year you will have to file the I130 like the rest of us via Chicago Lockbox
