I-130 for stepdaughter

Hi all!

I am sure I have posted something previously, but cannot find it. I also cannot make heads nor tails of the little charts showing the dates, etc.

So, filed I-130 for my stepdaughter back in August. We have had one letter giving us a receipt number. When I do a status check, it still shows in initial review. She did not come for Christmas and is really trying to just bide her time whilst waiting. She is more than a little frustrated that her cousin's fiance visa is going through quicker than hers. His has been filed in the UK, whilst hers has been filed from here in the US. He has been able to travel to and from the US with no problems and that is grating on her as well.

Do you think there is any way we can get her here with us whilst waiting and maybe adjust status and have her interview here? She is living with her grandparents, but it is not ideal and her job has ended. She is under 21 until July. I am also afraid she will age out.

hi

did the marriage take place before her 18th birthday? if so they are 2 different processes and she shouldn't compare. the petition while being abroad can take over a year. the i130 can take more than 5 months

Yes, the marriage making her my stepdaughter took place a number of years ago. Her father is a permanent resident now, but is eligible for citizenship this month. We have explained to her that filing from the UK is a much quicker process than filing from the US. When we applied for my DH, it was all quite quick. We filed for him in May and he had his visa in November. She chose to wait this long, rather than go through it with her dad. Ah well.

Thank you again. I am hoping that there can be some way for her to come over whilst waiting for the remaining processes.

does she hold a UK passport? If so, look into ESTA, as the UK is a member to the Visa Waiver Program. Sure, it's only 90 days at a time, but hey - 90 days is 90 days.

She does, The ESTA people have said that if she applies for one now, she could be turned away upon arrival to the US, as she has a visa in process.
