CONCURRENT FILING FORM I-485 ALONG WITH AN APPROVED FORM I-130 PETITION

I read documentation on concurrent on filing and my husband and i seem to think this is the fastest way to adjust status. I-791 requires filing status adjustment 90 days before your 2 years anniversary.Base on the 2 step process under the section "green card of an immidiate relative of a U.S Citizen" it looks like this is the fastest for adjustment of status while in U.S. Is this the correct path? or am i misreading this section?( http://www.uscis.gov/green-card/green-card-through-family/green-card-immediate-relative-us-citizen )

USCIS STAGE :

05/03/13 : I-130 Filed

05/06/13 : NOA1

11/22/13 : Case transfered to NSC

12/12/13 : NOA2

12/16/13 : Shipped to NVC

NVC STAGE :

01/08/14 : NVC recieved the case

02/06/14 : Case number assigned and IIN/BIN

02/11/14 : DS-261 Available and completed

02/12/14 : Received e-mail to pay AOS Fee

02/13/14 : AOS bill invoice available and paid

02/15/14 : AOS Mailed

02/18/14 : AOS status shows paid

02/19/14 : NVC received AOS package

02/28/14 : Received e-mail to pay IV Fee

02/28/14 : IV bill invoiced

03/03/14 : IV bill available and paid

03/06/14 : IV bill shows paid

I just wanna make sure if it's possible to file a form I-485 along with an approved I-130 petition.Meaning you don't have to wait 90 days before your 2nd wedding anniversary to file for form I-485.

11.18.2013 - requested expedite due to typhoon

12.02.2013 - CFO seminar

12.12.2013 - I-130 approved, NOA2 via email (never transferred); shipped to NVC

12.30.2013 - NVC received the case

01.06.2014 - requested expedite due to typhoon and PCS

01.08.2014 - Case # and IIN; submitted DS-261; NVC asked for 2 contact #s of beneficiary

01.09.2014 - AOS fee billed

01.14.2014 - AOS fee showed paid

01.15.2014 - IV fee billed; expedite approved

01.18.2014 - sent AOS package

01.22.2014 - IV fee showed paid; AOS arrived at NVC as per UPS (10:18am by FNU)

01.24.2014 - sent IV package

01.27.2014 - submitted DS-260; IV docs delivered to NVC as per DHL (10:52am by PETERS G)

01.29.2014 - CASE COMPLETE (via phonecall)

01.30.2014 - received checklist for Dutch Police Record (VOG) via email

You don;t file form I-485 for Removal of Conditions. The Adjustment of Status process and the Removal of Conditions process are very different.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

possible? Sure !

caveats:

1. beneficiary must be in the USA already and

2. must shift approved I-130 from NVC (where it's at now) to USCIS for adjustment of status process - sometimes filing the I-824 and paying the transfer fee .

But, that, in and of itself, means nothing if you, instead, decide to stay on the immigrant visa path.

If you are chasing an immigrant Visa, a CR-1, why not handle the doc intake at NVC instead? If you want to flip to IR-1 designation , just go slow at NVC now, so that you have an interview 2 years after 2013-03-12, the date of your marriage (per yer timeline).

Usually folk who are seeking an immigrant visa with a consular interview DO NOT muck around with any I-485, as that's used for an adjustment of status case, leading to a 2 year greencard. This idea of your 2 year wedding anniversary, mixed with 90 days waiting, mixed with an I-485 filed for an adjustment of status - normally this is not done due to other concerns with the waiting (being in the USA on a tourist visa, out of status, for example, or coming in on a tourist visa and not telling CBP your intentions to adjust status at the POE).

For me, your question is troublesome. Can you be more specific, with what you're trying to attempt? Thanks so much, and Thanks is Advance !

Sorry about the confusion. Once i get to USA, I know that filing I-751 (petition to remove conditions during the 90 days before my conditional residence expires) is the next step. I was just reading around the USCIS website and came upon this "adjustment of status" subject using form I-485. Specifically this link http://www.uscis.gov/green-card/green-card-through-family/green-card-immediate-relative-us-citizen . My husband and I are new to this process and are just trying to educate ourselves on the subject thus my original post. Just posing some questions out there for my own education on this whole exciting and sometimes frustrating "Visa Journey" experience. Ohhh the waiting....is the hardest part. Thanks to all for the info.

Ok, so you're not adjusting status, you're waiting for NVC side of immigrant visa processing.

You will be doing Removing of Conditions (I-751) - it's not tied to your marriage anniversary but the date you enter into the US - resident since date on your 2-yr green card. You will file 2 yrs minus 90 days from your resident since date.

No I'm not and yes I am still waiting for my immigrant visa to get approve,right now I'm in the middle of processing.Thanks for the info :)
