I need some help and advice on how to file for ROC in the best way possible, to minimize any hassle or problems.

I am a Swedish citizen, and I came to the US (for the second time) in the beginning of June 2012.

2 weeks after my arrival my husband (we were not married at the time) got diagnosed with a rare and aggressive cancer that came out of the blue. We got married in the end of July 2012, filed for a green card, and I got my green card in Nov 2012 without any difficulties.

He passed away in the end of June 2013 after a long battle, which we were hoping he would win. His death came sudden.

I am planning to file for ROC very soon, and I would appreciate some help in this matter, especially when it comes to proving that our marriage was real.

We did have a joint bank account for a little while (we closed it later on), and I do have a couple of papers from the bank with both our names on it. I used my swedish bank account, because I wasn't able to work since I had to stay with my husband and help him out with everything, since he was disabled.

I have an ID card, from his auto policy, where both our names are printed that I will use as evidence as well.

I have our marriage certificate and his death certificate.

I will also ask his mother and a friend of his (that used to visit us at the hospital) to write a letter about me and my husband's relationship and that it was a real marriage based on love.

I have letters/cards that members of his family, and hospital staff, sent with condolences after his death. I also have a letter that his doctor sent to the family.

I will also write a letter, explaining the events, why we didn't have a joint bank account, and that our marriage was based on love.

I have some pictures of us two together as well.

I wasn't allowed to receive any of his medical records from his health insurance company, could this be a problem if I don't attach any medical records when filing for ROC? I didn't attach any medical records when filing for my green card.

We are very sorry for your loss. Gather all the information possible and you can file now using his death certificate for removal of condition. I am sure you will get approval.

1. Get all the monthly statements of the joint account for the time you had. Also explain in the cover letter why you didn't have a joint account for the entire period.

2. Get affidavits from his mother and that friend.

3. Pictures are good - in your case you need to send more. Just print on ordinary paper.

4. Write to his company asking for a letter stating that you were covered in his medical coverage. You may get a cobra letter, which you can use.

5. Get a letter from where ever you both were living - best is to get a lease, if you have.

6. Get letters from the hospital regarding the cancer treatment.

10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

What is the best way to contact a hospital to get information about the treatments? Are they even allowed to give out information about that?

I'm not exactly sure if all hospitals work the same way. For my doctor visits, I signed a release form authorizing my husband to access my medical records if need be and he is the only one authorized to do so. And since you are his legitimate wife I don't think you would have a problem.

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

I'm not exactly sure if all hospitals work the same way. For my doctor visits, I signed a release form authorizing my husband to access my medical records if need be and he is the only one authorized to do so. And since you are his legitimate wife I don't think you would have a problem.

Ok, thank you, I'll try to contact the hospital to see if they can help me out.

I did sign different forms at the hospital, since my husband wasn't able to do it himself but I don't know if that also automatically will allow me to access his medical records.
