Hello,


My fiance is here in the States on the K1 visa, and it is valid until February 7, 2014. I was wondering, do we have to have the marriage certificate by February 7th, or do we have to get married by February 7th? (The marriage certificate can take up to 15 days).

OP, what was the date of your fiancé's arrival in the US, you have 90 days from the date of entry to get married. One a K1 visa is used at a POE, the expiration date becomes irrelevant.

It doesnt matter the expiration date of the visa.

Inmediatelky your fiance enter to usa , you have 90 days to get marry.

If your fiance entered to usa on december 1 rst you need to get marry before march 1 first for example .

You mistaken there. it's 90 days. Not 3 months. So, he probably does not have till 1st march.

As I understand it, you should not go by when the visa expires. It is 90 days from the day your fiancé enters the country. My K1 visa expires a little after your fiancé's does, but I entered the country on October 20th, meaning I had until January 18th to get married.

We were also given our marriage certificate immediately, so it might not take 15 days.

Do it as soon as you can!

OP - per yer timeline,

you two have 90 days from 2013-11-10 to get married.

Plan accordingly, and go download an I-94 nowish, if not have one.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Your timeline says entry was Nov 10th. Your starting date is November 10, 2013 so that means that 90 days later would be February 8, 2014. http://www.convertunits.com/dates/90/daysfrom/Nov+10,+2013

So yes, get married by the 7th. You do not have to get the marriage certificate back from the court after your marriage is registered by the 7th. You just have to be married by then so that you marry within 90 days of entry.

Thank you everyone!

I know we have to get married within 90 days, but since the customs officer stamped the passport stating that the K1 status was valid until february 7th, 2014, I thought that meant that we had until the 7th to get married.

We had chosen a specific date in february because it has a special meaning for us, which is why we are waiting until the beginning of february.

It's one and the same thing. Your K1 technically expired the moment you went thru POE. Your I-94 is good for 90 days, and it is by the expiration date of that yu must be married. So if she arrived 10 Nov 12, you must marry by midnight on 7 Feb 14.
