No, My wife promised me that we would all go back together to visit my aunts and brother's family n so on but when she came here...she hid my sons passport and told me i can't have it so it seems like she has changed her word and broke her promise so i would defenitaly want for all of us to go back or at least me and my son because he is Egyptian too and lived there more than he did here so its his home country.

All of which will mean nothing in a USA family court where the marriage has broken down and going through a divorce. You son is a USA citizen, residing in the USA, and under USA laws. I was just trying to let you know the uphill battle you face in an attempt to get sole custody and be able to leave the country with him, or move him there. The odds of winning that in court here with even the best of attorneys are pretty much zero.

Always the best results from family court in the USA come about when two responsible parents agree to put aside their marriage differences and work together for the best interest of the child and what is fair for both parents. When one tries to terminate the rights of the other, and/or remove that child from the country, you can bet there's not going to be any reasonable agreement between the parents. So the courts will settle it and impose their view of what is fair and just, which will not include your ability to take the child to another state, let alone another country. Your only way you'll ever get that is to work with your wife and get her permission. Something it doesn't sound like is going to happen.

You can talk with lawyers, an honest lawyer is going to pretty much tell you what I've said and give you better information on the local bias and rules your local courts follow. In fact given the level of disagreement your wife and you apparently have, you're going to need a good lawyer. They're not going to take away your right to see your son, unless there's been proven abuse by you. But you're not going to get what it sounds like you want either.

I am certain that you will not be able to leave the country with your son without your wife's approval. This is a relatively new law to prevent foreign parents from leaving the US with children so that the USC parent has no access to them.

Furthermore, getting a divorce here in the US will not be quick, and will damage both you and your child a great deal, in ways you cannot imagine now. There will be periods of separation which you have no control over. You will be painted as a villain, although you know yourself to be a good person.

During my divorce from my USC wife, I thought it would be a distinct possibility that my wife would leave and I would never see my son again. (This is called parental kidnapping, and it is not uncommon here.) Quietly, without her knowledge, I made sure that he knew my cell phone number (and never changed it), so that if he ever got the chance, he could call me. I made certain that I had a copy of his fingerprints, so that he might be found again. And I also made certain that the sheriff's department in our county had a copy of the ID card with his thumb print on it. These may seem like excessive measures, but I had some peace of mind knowing that if the worst should happen, I would see him again.

Fortunately, I did not have need of any of these things. But you may.

Start documenting every thing and I mean everything. Times, dates, photos, diary

Set up a new yahoo account. i.e. fatherson@yaoo.com.

Make this your diary account. Use it only to document your son, wife, living conditions. When you take photos, email them to this acccount and then destroy them on the camara. Do not leave anything lying around where someone might find it.

Bro, your in trailer park hell.

It's time for you to move out ( yes, that means leaving your son for the meantime ), get yourself employment, set up a househould, get your life cleaned up, then HIRE an attourney, and go for the juglar vain on her.

Remember, you do not need an expensive place, you need a place of your own.

Good luck. Take note, your living in a caustic atmosphere. You need to get out. Also, the damage to your son has already been done. There is nothing you can do about that now. Get your self stable and settled. Then go after your son.

Also, what ever you do : DO NOT FILE FOR SOCIAL SUPPORT i.e. welfare, food stamps, etc etc

At this stage it will work against you.

If you have to work 3 jobs to make ends meet, do it. The judge will completely respect you when it comes time to make decisions.

Please keep in mind that some dates are only known after receipt of another document.
For example, the USPS Form 3811. The stamped receiving date was not know until the original Form 3811 was received on 07/13/2013 1:30 p/m CST.

A little note from a father that has fought for his rights in court. It took me about 4 years of planning and over $20,000 in lawyer fees to just get primary placement with my daughter and be allowed to leave the state with her. I did prove mom was unfit to care for the child and it was not easy. You need real evidence not someone else's word on what did or does happen. It can not be that you just do not like what is going on. My daughter was being neglected, she was diagnosed with stage 2 hypertension and her mom was not making sure that my daughter was taking her medication. I got proof of this along with my ex admitting that she did not feel there was anything wrong with the kid. We had my daughter in therapy for 3 years to get help from therapist. It was a very long and expensive battle that is not easy for a father to win because the courts do usually side with the mother.

What you are talking about is going to take a very long time and consume your life. While everything is going on there will be an intern order decided who has the child and for how long. That can take time to get as it took me about 6 months and during that time my ex did not allow me to see my daughter either.

I'm sorry that I have no good news for you but I know how ruff it is as I was divorced when my child was 1 year old and started to go for primary placement (Still shared custody) when she was about 8 and was awarded when she was about 11. I have been to court with my ex about 6 times and it is always a mess.

Dude you have to get sorted out & get a job & your place

your son cannot exist on love alone and U need to get him

out of that anger & dysfunction B4 he gets to be like the rest

of his family.Then you can file for custody, no there are some

countrys no judge in the US will let a father take a USC child

to from the mother....too many horror stories.

The both parents have to be in the childs life inside the US

Years ago the state Dept. warned USC women about

travelling to certain countries with faraway husbands on

so-call vacations with kids. a large number of kids was

taken from them, the state dept. cannot help because their laws

are that wives and kids are owned by husband, many of them

passports were taken away and to top it off these countries

needs one to have an exit visa to leave, going to the US embassy

there for travel docs wont help because the exit visa is from their

gov.. There have been instances where wives were allowed to

leave without the kids, and mortgage homes in the US to hire renegade

groups to get them out, no way will you get full custody via court or

approval to take that child to Egypt, nor would the mother allow it. I am

not saying you are not having a hard time with her family but did

she have a jolly time with yours? Get a job and a room for yourself

then you can spend quality time with your son in the US as you

have the right to. its 2 sides to every story and seemingly both

families are dysfunctional, I hope your son grow up to get past

this and be a fine young man.

Egypt actually has a heavy bias towards the mother. They will not recognise child custody orders from outside the country though. And the mother would need to fight in court there to get custody. Visitation rights to the noncustodial parent, is up to the custodial parent's whim. If a child is abducted and brought to Egypt, there is no recourse to get that child back, except to fight for custody within Egypt. One has to wonder, since its a Sharia court, if there is a bias against non-muslims. Egypt is not a signer of the Hague Convention on child abductions. If the op is from a culture where women get the children if under age 15, and visitation is only at the mother's discretion, he may be very afraid the same holds true here and he can be totally excluded from his child's life. Sounds to me like making a life in the USA, and being a part of his child's life is much more likely if he stays in the USA.
