January 2014 AOS Filers

I think many of us are in the same boat! Our USCIS updates haven't moved since they received our application 1/23. Still just says "acceptance". My husband also got his EAD in March. Did you by chance get the interview waiver letter? We got the waiver letter in April which specifically says that we shouldn't try to contact them unless we haven't heard anything by 6 months from the date of the receipt of the waiver letter which for us will be in late October.

Our lawyer filed everything, and the forms were I-130, I-485, and I-765. The USCIS website only shows the "Last updated" date, which on our case is the date they updated our address on file.

I haven't received an interview waiver and you're

spot-on that being able to work and get/renew a driver license is a huge benefit as we wait.

In our case, my wife and I are hoping to be able to travel abroad on vacation and to visit her family, and we had to postpone a trip we booked because our case fell so far behind the standard timeline. Hopefully we'll interview soon!

It looks like we're not alone in this boat! The only difference is that we already had our interview, but it seems that the clock somehow got restarted since we had to submit more docs after the interview.

As I read your post I was wondering whether you got your combined EAD/AP card (it looks like you got at least the EAD). If yes, can't you go visit your family abroad using that?

You said your wife got her EAD in March, is it the combo EAD/AP card since that's what you filed for? If so, there's no reason why you shouldn't be able to travel that's the purpose of the AP to allow you to travel. I've seen various posts on here about they may detain your wife on her way back in to ask additional questions but that AP card gives you the right to leave the country while your case is being processed and I've seen lots of posts throughout the forum from people who've traveled with their AP cards!

10/8/14: Called USCIS and was allowed to file a Service Request since we're outside of normal processing times for our local office. Should have a response in 15-30 days.

10/29/14: Received letter (dated 10/27/14, exactly 1 day before the 6 month mark) stating that our case would be transferred to the Houston field office for processing.

11/28/14: Received letter (dated 11/20/14) stating that our case had been received at the Sacremento office and would be processed there and if we don't hear from them in 60 days to contact NVC.

12/9/14: Card is in production

12/16/14: 2 year card in hand!

You said your wife got her EAD in March, is it the combo EAD/AP card since that's what you filed for? I've seen various posts on here about they may detain your wife on her way back in to ask additional questions but that AP card gives you the right to leave the country while your case is being processed and I've seen lots of posts throughout the forum from people who've traveled with their AP cards!

We traveled with an AP card for my wife and the officer at JFK didn't ask any questions whatsoever when we came back. Just took a brief look at the AP card, took a look at the original K1 visa, asked her to do fingerprints and photo, stamped the passport, and that's it. No problems whatsoever, no questions, no secondary, nothing.

As I read your post I was wondering whether you got your combined EAD/AP card (it looks like you got at least the EAD). If yes, can't you go visit your family abroad using that?

We didn't file for AP because our lawyer said it would be smart to avoid any risk. My wife had overstayed and quite frankly it provides much more peace of mind to wait and travel with the green card in hand than just the EAD/AP and wonder "What if?" the whole time. Also, we didn't expect it to take so long, so there was less urgency to get the AP document.

Congrats to those recently approved!

Next week will mark thirty days since our lawyer filed an information request from USCIS, following over six months of inactivity in our case. Hopefully by the end of next week we will better understand roughly how much longer we have to wait for our interview to be scheduled.

Decision

On September 2, 2014, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
