Quick question relating to the I-864.

I have to have a joint sponsor who lives in the US and that's good, I have his completed I-864 forms, last IRS return plus a photocopy of his passport to prove US citizenship.

My husband (petitioner) has dual nationality UK and US and has lived here in the UK with me for the last 8 years. He still has kept his US family address, current NY state driving license, US bank account and credit card. So after reading all the good stuff on here we are all set with our letter of domicile intent.

2 x Questions for you guys:

  • Will London DCF accept a photocopy of the joint sponsor's (my brother-in-law) passport or do I need the actual original passport at my interview to accompany his completed I-184 and copy of tax return? He lives in NY and I could get his passport here but better if they would accept a photocopy of his passport?
  • My husband has to be a sponsor as my petitioner but what does he answer on his I-864 to question 5 concerning Country of Domicile? As a dual national he has been living here for 8 yrs. Does he answer country of domicile as the UK or US (despite the fact we are both moving back to the US permanently together)?

Really appreciate the help I don't want to get this wrong!

1. A copy should be fine.

2. It's a little more complicated than that. He's going to need to show he actually has a US domicile or has made a good faith effort to reestablish one, since he has been resident abroad for so long. This can be done in a variety of ways, like securing a place to live, a job offer, having a voting record, state driving licence etc. Take a look at the instruction PDF for the I-864 - it explains a bit about domicile requirements for sponsors. The stuff you listed may be enough already. So he should probably be listing his domicile address on that form as the US one.

12 Dec 2013: NOA2 APPROVED
7 Jan 2014: LND number and packet 3 arrived (dated 2 Jan)

10 Jan 2014: DS-260 and Notification of Readiness completed online

20 Jan 2014: Medical

20 February 2014: Interview scheduled (emailed embassy via the contact form on 5 Feb)

Looks like we have similar timelines in London! I am the petitioner for my husbands visa, am wondering about the same thing on the I-864 form itself. I think I am going to put my intended US address on the form, after reading loads of forums and trying to interpret the instructions. If I find out any other info I will try and share it here.

On my partner's 1-864 I think we are going with our US address in NY as our mailing address, place of residence as our UK address (where we are currently living) smile.png and place of domicile as United States. Is that what you intend?
