U.S. citizen marrying Brazilian intending to continue college

Hello, all.

I am an U.S. citizen in a relationship with a Brazilian citizen. We've been in a long-distance relationship for about 2 years now, visiting each other more or less every six months.

We've recently decided that we want to get married to be with each other. We've had no trouble researching on how this can be done, but the problem we have is that she is currently attending college in Brazil and would like to continue her education at my school, the University of Texas.

We want to know whether, as my wife, she would be considered a resident of Texas and thus pay Texas resident tuition?

Also, how soon does it take for her to be considered a Texas resident? Would she be considered one as soon as she receives her green card?

No the green card doesn't make her automatically a Texas resident.

Q. How do I establish residency?

A. One must be an independent (not claimed as a dependent for income tax purposes), US citizen or permanent resident, (have a green card, also known as card I-551 or the evidence of I-551 stamp in the passport) or international student who is eligible to establish a domicile in Texas and live in the state of Texas for 12 consecutive months and establish a domicile in Texas prior to enrollment.

You should check with UT financial office to be sure.

The in-state tuition rules often vary by state and by school.

I believe once you two are married, and she obtains the green card,

highly likely she will be considered in-state, especially if you are

tax paying Texas resident for more than 12 months.

Assuming you are yourself a Texas resident or would qualify as one within the next year, your wife will have to have been married to you for a year before she qualifies as an in-state resident, her green card doesn't matter (and at least in Texas, isn't strictly necessary). The university will require you to prove both parts of this (that you would qualify as a Texas resident, and that you two have been married for a year).
