I know it seems stupid to you and many others why would you come and not return but stop for a minute and think like the interviewing CO. What will you be presenting to them to convince them you have every reason to return?

They see a man saying at interview "I miss my wife". And he has no job part time school not much to convince you will return.

And frankly you have ever reason to stay in the US why else are you filing a petition to immigrate. See you have already shown your intent to immigrate. And unfortunately many before you came to "visit" and never went back so you and I and many others have to pay for the sins of the ones before us.

All you can do is try.

That's the part I don't understand. By filing the petition we have show our intent to immigrate LEGALLY. Why would we waste the time and money already spent to live illegally for the rest of our lives?

Cuz there is No one on earth gonna apply for a LEGAL visa and Go trought ILLUGAL visa . That's Such Bullsh*** .

1) you can try for the tourist visa of course. If you are looking for regional experiences you are best off to look at them in your REGIONAL forum. I never had a problem visiting my husband but I also don't require a visa to do so.

2) you are being VERY rude. Someone is wishing you best of luck but trying to make sure you do not get your hopes up. People do it ALL THE TIME!!! They apply for an immigrant visa and then go to visit and decide to adjust their status instead. It happens quite frequently. There was a Canadian beneficiary who did JUST THAT not too long ago because they felt their petition was taking too long. Sure they can say that they didn't have the intention to stay but really? It's the CBP's decision however to let them in, not mine, and once they're in, it's on the USCIS to prove they lied at the border. One day you'll see that Canadians will need visas to visit the USA too. So your argument is invalid. While it's legal to adjust status from a tourist visa, it will be very hard for high fraud countries, like yours, to get tourist visas, with a USC spouse. Do not blame anyone else except the people from your country who made it harder on you. It's not Dwheels fault, she simply doesn't want you to get too excited if it doesn't work out but I can tell you she'd be the first to cheer you on if you made it!

I do wish you the best of luck. We all know how hard it is to not be able to visit with your spouse. Your wife likely can take time off work she just won't be paid for it. To some people that means they don't take time off because they need their job to support themselves. Why don't you get a job and send money to your wife so that she can afford to take time off work that's unpaid to come visit you? Just a thought? You don't have to, it's your choice, but I know my husband paid for all but one of my trips to see him and all of the immigration fees even when he wasn't working.

I don't need a visa. I never did. Canada has a special agreement with the USA where we don't need visas. Other countries are call "visa waiver program." Google it. They fill out some forms for something called ESTA and if they are approved they don't need a visitor visa for the USA. Other countries need a visa to visit the USA. No, there isn't the same law for everyone, it depends on how often people have violated US laws, committed visa fraud, or otherwise have poor relations with the USA. The USA in general also seems to feel that everyone wants to move there, which after talking to other immigrants, is simply not the case. I wish my husband had moved to Canada instead, as was our original plan until he was employed at his current career.

I only get 2 weeks of paid vacation a year, I work in retail, but I can take as much time off as I want, I'm just not paid for it. Obviously if I take too much off it's possible I can be fired because I'm never at work, but at that point, I'd quit before then. If your wife's work says she cannot possibly take time off even if it's unpaid, well that's her workplace rules which, IMO, are ridiculous. She may want to consider a place to work that doesn't have rules like that. Then again I'm really not fond of the way a lot of the US does it rights for workers and health care. Anyhow, best of luck to you. I hope your journey is quick and relatively painless. I'm hope you get the visitor visa so you can visit.

Yes mme i understand u so clearly , but morocco has a strong relation with The USA we can see that by the present of our king in the USA recently + the afro americain congress was in morocco 4 days ago + we have The longest relationship with the USA sense 1777

It's not from the relationship . it's from what does moroccans did when they get the'yre tourist visa i admit that a lot of them get it and never come back . YES THATS TRUE

But it's not like i want a tourist visa to go sit there while i'm legulay have the right to stay with my wife wich we are pending Two visas "Cr1" and "K3" that shows that i don't need a tourist visa to live illugaly why i will do that ? Do u know what i'm saying

+ the law of the company that my wife work with pays only for one week of break in the Year . so my wife didn't get paid in that month and one week off

. So now it's not about her taking a break it's about if she want to take break they will fire her

I'm telling u ur so lucky to go visit ur husband but me and my wife were in pain for like 3 months now . i know a lot of people wait more and more

but seriously i can't just stay waiting what if the processing takes One year . then i won't be able to see her for the hall year

that's what i'm going to say to consuler . Hopefully i get it to see my wife

And thank u so much for the informations :)

Unfortunately you're right, it's the people that visit that don't go back that make it hard on people like you. What dwheels is trying to explain is that from the USA's standpoint, they think EVERYONE wants to immigrant and essentially, you are guilty and must prove your innocence. Because you have a USC wife, that's VERY difficult to do. This is what they ask: Why would you go back? Why would they believe you? Remember you married an American and you have paperwork that says you want to move to the USA. In their eyes, you have no reason to go back to Morocco and other people have proven them right. I know when we miss the other person it's really hard to look at it objectively instead of emotionally. I totally get what you are saying and I believe you, but the consulate officers are already biased and the answer is always no until you can get them to say yes. The more ties you can prove to Morocco the better. Full time schooling, a good job, a lease agreement, family obligations etc... are all things you can use to help prove you won't stay in the USA.

I was lucky to be able to visit my husband. I was very lucky he had money saved up from when he was in the Air Force to be able to pay for my visits as well. I certainly couldn't afford it very often on my salary and I paid for everything in Canada on my own. My car, my rent, my bills, my food, and any care my daughter needed. It took me a few months to pay off the trip I did pay for myself as it was. I know about the 3 month mark where you are at; it is one of the hardest. It was always about then that we missed each other the most. I was also very fortunate to be completely done the entire process in exactly 9 months. So you never know, you might be done quicker than you think.

I'm sorry your wife's work place is like that. It's really not fair that someone cannot take unpaid time at work and worry about being fired. I guess the moral to that is life isn't fair and the USA is about capitalism. Sigh. :(

It's ironic to use the word high-fraud countries, since after joining this forum, I have seen people from european countries with visa waiver program and canadians are the ones who really abuse the visa-free system and use it to abuse it. I can forsee that raising red flags with USCIS in near future.
