Nothing wrong with trying especially if you aren't concerned about the cost of doing so. Unless you can prove beyond a doubt you MUST return you will be denied. Once that is done you can apply again. Actually you can apply as many times as you want to until you have proven to yourself they will never grant you a tourist visa. These denials will not change your chances of a different visa in the future.

Make a list of what things force you to return. Having a job wont change the outcome for example.

I suggest you read up on the possibility of your immigrant case going into A P. This is very possible in a case where the people are your ages. I offer this because you have not understood peoples attempt to help you here which is simply due to your lack of knowledge of these difficult processes. Hopefully you will avoid the black hole of A P when the time comes but you need to be aware of the possibility.

We went to the U.S Embassy in Jordan and applied for a non immigrant visa before we filed our I130 package..my husband was denied...even though I was having major surgery when I got back into the U.S. The consulate told me that she would allow him to come to the US with me when I went in to visit her alone...but when my husband went in for his interview..he was denied..because his ties was stronger to the US than to his own country...it won't hurt to try...but if they deny you...just try to swallow it up...it is normal to get denied.

Agree...hope for the best and prepare for the worst. Don't get too hung up on timelines and averages, but rather focus on what you can do to influence the process. This is a little like the Army, hurry up and wait. Embrace the suck and all that.

Get a hobby, spend time with friends, etc. as another poster suggested. Create relationships with others on VJ and trade tips on how to cope. Pray if that is your thing. Volunteer your time. Build skills that are useful for your future life in the US. The time will pass and before you know it you are united with your loved one.

Hello everyone . From the tittle it's clear what i asked

I filled out a "b2" visa to go visit my wife . cuz her work doesn't allow her to have any vaccation this year cuz she took 1 month And 2 weeks wich is not normal in the USA O.o

We applied for a "Cr1" and a "K3" Visa but they both take so long to get process . It's our first year from marriage we didn't have our honeymoon yet so my wife offer me to apply for visitor visa and come to her to pass our honeymoon and see each other for awhile

My question is does anyone did that from before and what i need for the interview ?? I have interview on 22,february

Unfortunately, your pending applications are for you to permanently move to the U.S.A. That is the strongest show of intent to migrate. It still will not hurt to go for the B2 visa interview but to be honest, chances of getting approved is extremely low. Good luck and hope u are an exception.

Two main points to remember for your interview:

> COs are required to assume that the applicant is an intending immigrant so the burden of proof is on your shoulders that their assumption is wrong and that you're really just a tourist.

> Your CR1 application already shows that you do intend to immigrate to the US so you'll need extra powerful proof to show that you will be coming back to Morocco backed up by evidences that they can look at if you want to.

Factor in the success rate of tourist visa applications for your demographic and you'll have a good idea of what you're up against. I'm not trying to discourage you but it's better to be prepared mentally for your interview so you'll be able to answer all the CO's questions confidently.

Btw, the CO will ask you why you want to travel to the US, where you'll be staying and who will be covering the expenses for your trip. They really don't care very much about your US contact but they want to be 100% assured that you can afford to go to the US and fly back home on your own. I'm from a country where it's difficult to get a tourist visa too regardless of whether there's a pending petition or not too. Just don't lie or create false stories because that can get you banned.

Did you and your wife ever consider a K-1 visa, get engaged, then file a K-1 instead of Cr-1? K-1 is usually, 1/2 the time as the visa you are seeking. Then be married in the USA, and adjust status. Just wondering if you explored all your options.,.,.,.

As for getting a visa with Cr-1 pending, unless you have the job, the money, the residence, all of what was mentioned here, it would be great if you could, but your chances are slim to none.,.,,but stranger things have happened.,,.do the best you can, and maybe it will happen for you!

Well i'm in good situation in here it's like i need to go and look for job or anything , i'm perfect in my country "Hamdoulilah" . And i didn't want to work in here bcz i'm gonna live with my wife , bcz in my work "vet assistant" u can't just go work . U have to sing a contract and the less one force u to sing for 5 years .

I will not tell them that i miss my wife . I will say . We Apply for this visa because we wanna pass our honeymoon and my wife cannot visit me bcz she took too much time from her work so that she can't visit me this year . And we both know that the cr1 visa take too much time so my wife offer me to visit her and see her and pass sometime with her to go see her familly and do our honeymoon

And yes i agree with u . WE ARE PAYING WHAT OTHER STUPID PEOPLE DID . THat just PISS ME OFF EVERYTIME

May I suggest you get a letter from your wife's employer stating that she would not be able to travel because she took 1 month 2 weeks vacation last year.

It's not an expensive visa. No harm in trying. We tried while our K-1 was pending. The CO said with a K-1 pending she could not issue a B.

The burden is on the applicant to prove significant ties to your home country. Substantial assets, good paying job, property, etc.

Simply stating you will go back, that you have no reason to stay in the US won;t cut it because you have already shown a desire to live in the US by filing for a spouse visa.

Having a wife in the US would be a strong reason to stay. You will have to provide stronger proof that you will rather go back.

slowlyman is right. We tried too, and they said exactly that he couldn't issue a B visa because of our pending K1. I don't know if its the same when you're going through a different process.

Maybe she will visit you? I have been with my fiance for 5+ months. I know it could be difficult for her with her employment but just a visit would be nice for the two of you.

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

You asked for personal experiences... So here's ours:

My Fiance is from the Dominican Republic (High Fraud). While waiting for our K-1 to be approved my Fiance applied for a Tourist Visa.

Like you he is not working, not in school full-time and does not have strong ties to his home country. He owns a vehicle but that's about it.

I wrote and signed a Notarized letter beautifully explaining that we understood it would be FRAUDULENT if he stayed or married, and would ruin our chances at his later legally immigrating on our K-1!

I sent along Pay Stubs, etc and promised that I would be responsible for his entering and leaving and all financial needs while here, that we just wanted to be able to plan our wedding like regular couples... and he brought all his paperwork per the application.

The application fee was about $160 USD and the Consulate Officer at the window looked at EXACTLY NONE of the things he brought and rejected the visa in less than 2 minutes. They were only interested in proof of compelling reasons for him to return.... Basically things that would cause financial loss if he did not return. Since he had none, they had no interest in considering anything else.

Several months later our visa petition was approved for our K-1 Visa though!! And we were approved at our interview 3 months after that... and now we are in AP and waiting for our Visa to be issued.

It sucks but here is the simplest way I can explain it is:

Tourist Visa = "I have NO INTENTION to stay in the US"

K-1, CR-1 Visa, etc. = "I have NO INTENTION TO LEAVE the US"

It's not impossible but in this case and cases like it, it is highly improbable.... you already told them you want to stay.

I sincerely wish you and your Wife, the best in your Journey but the best advice is as suggested by someone previously.. Find hobbies, find a temporary job or volunteer, find ways to cope with the absence and separation... Time and distance and expensive phone bills, etc aren't fun and pretty much everyone here DOES understand your pain... and we are ALL in a similar situation in respect to waiting and hoping and missing our chosen Loves, even if we see them more often, it still is gut-wrenching to leave them over and over, it never gets easier.... in fact I think it gets harder to voluntarily separate again... Somedays I laugh thinking that once he is here we will not ever be more than 10 feet apart!

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)
