Desperate: VWP from UK, AOS? Pls HELP

Hello All,

I'm a US citizen married to a UK national. We have 2 kids (1yr old and 3yr old) together and they were born in the UK. Our kids are USC and British citizens. We met 10yrs ago but got married in Maryland 5 years ago (July 2008) and she went back to UK a week after. I lost my job during the recession at the end of (Nov) 2008 and I went to London to live with her. I recently got a job in the US and decided to take it. I brought my 3yr old with me (2 month ago) to relieve my wife of the burden of juggling work and 2 kids at the same time. She visited me about a month ago with 1yr old and we've decided to stay together in the US. Our decision is based on the time apart during the GC process abroad (6-12months) and the kids education as well. I would appreciate if anyone can help me figure out our next step. We are looking at the AOS option so we can keep our family together during the process. Please advise. Thanks.

OP- yes, you can file. They may be suspicious because when travelling on the VWP, your wife was not supposed to have immigrant intent (entering the USA and planning to stay would be visa fraud). Good ways to prove that would be showing her job expected her back, she left pets behind,m still has a lease, kid enrolled in daycare etc.
