Hey Nancy,

I believe you somewhat satisfied the requirement for financial co-mingling, but your original I-751 package lacked communal residence evidence. If any, the most important two things USCIS is looking for at a I-751 application is the sharing of finance and living.

Are you guys working or still going to school? It's strange they asked for 2013 tax return. I submitted only 2011 and 2012.

Sad news, I just received the RFE for 2013 tax and older lease agreement :-( When I sent the I-751 we hadn't filed tax yet. I was careless enough to not send older lease. We are living same roof which my in-laws, I have notarized affadvit of communal residence from my father-in-law. I will send out all they need next week following:

  • Original Request for Evidence letter.
  • 2013 Federal and Arizona State joint tax returns.
  • 2011, 2012, 2013 joint tax transcripts.
  • Notarized Affidavit of Communal Residence by my father-in-law from Oct 1, 2012 until now.
  • Copy of Residential Lease Agreement of our previous residence from Oct 1, 2011 to Sept 30, 2012.
  • Blue Cross Blue Shield of Arizona Certificate of Health Coverage with all copies of continuous bill statements, renewed insurance cards from Feb 2012 until now with no gap period.
  • Copies of continuous Vehicle Insurance policies and payment statements from Jan 2012 until now with no gap period.
  • Copies of previous Internet Cable provider statements.

I explained in cover letter that I couldn't add my spouse on my bank because he has bad overdraft record with them and they refused to put him on my account. On my I-751 package, I sent following:

  • Copies of the passports and green cards.
  • Copies of driver licenses of us.
  • List of addresses I have resided since I am a permanent resident.
  • Two sworn affidavits by U.S. citizens, confirming our relationship and marriage.
  • Copies of the tax statements (Federal and AZ State) for 2011 and 2012.
  • Copy of the joint ownership title of our car. (we sold our old car back in July 2013, new one dated Aug 2013 and they said it too recent.)
  • Copies of joint Geico auto insurance card and payment notification. (current policy only)
  • Copies of joint AZ AAA auto service cards and account summary.
  • Copies of joint AZ BCBS health insurance card and bills. (3 recent bills, I should have sent all bills which I will do next week.)
  • Copies of Bank of America statements. The bank doesn’t let me to put my spouse name on my account because my spouse has an overdraft history with them.
  • Family pictures at different occasions.

Could you all have a look at my RFE and tell me if I need something else? Any inputs will be more than helpful to me. Thank you.

Sorry to hear that :(

I agree with Huy-le, your original package wasn't showing much in terms of common residence, but what you're planning to send with the RFE should do it.

I also think it's weird that they're asking for 2013 taxes since they were not due when your first applied, but by all means, do it if they asked. I don't know if you'll be able to get a return transcript yet (I requested one online just a week or so ago and it told me it wasn't available), if not, include a copy of the return itself including W2s and explain that in your letter.

You're gonna be fine, from what I've seen people get approved relatively fast after responding to RFEs

Thank you huy_le and Laure&Colin so much for your insights. I was careless to think that they already have my older lease on file, we submitted it when AOS. Yes this time I will include everything, all-in with them lol. I will express the RFE package tomorrow. Thank you and please have a prayer for me.

I requested tax transcripts last week and they were available for me. It's weird that it was not for you.

I am already preparing for my naturalization you know

Sorry to hear that :(

Yes! Go all-in with these guys. Include all that can prove you guys have been living together. Old leases, affidavits from landlords/in-laws. Also, spam them with bank statements, PG&E bills, all other bills that can point to the same address. I will pray for you.

Thank you huy_le and Laure&Colin so much for your insights. I was careless to think that they already have my older lease on file, we submitted it when AOS. What did you submit? Without that no one can give you an idea of what might have caused the delay. Sometimes it will just be that your application falls into the hands of seriously backlogged IOs. People who submit after may get approved before and that is how USCIS has been. Very little idea on why that is such the case.

Received my card today! :dancing:

That's a silly question, but what do you do with the old expired card when you receive the new one? Do you destroy it or keep it?

I want to follow up on the status of my case at the VSC, what's the number I should call? Thanks

I asked the IO during our AOS interview about my EAD card. He said I could do whatever I want, destroy it or keep it as a souvenir... I guess it's the same about the GC. Edited by didopage

Congrats! You can keep your old GC as souvenir because when you are naturalized they will ask you to return the 10-yr GC.

Btw, the N-400 thread is very disappointing, I asked a question and nobody is even looking at it. Gosh!
