I-130 Need help on submission!

Hello all.

I am in the process of filing the I-130 IR/CR-1 spouse visa for my wife in India. There are few things that I am very confused about and I haven't been able to get a clear answer. I asked a few people who went through a similar process and called the USCIS to answer my questions - but there was no clear answer as to what I needed to do. I don't want to hire a lawyer because I dont think it is necessary for simple filing questions that I have.

We are newly married couple that just got married on November 19th, 2013 in India. We met in March and had ongoing chats/calls etc of our ongoing communication including our wedding plans. Since we are newly wed, there is not too much evidence that I can provide at this point. Here is what I plan on submitting:

· Completed G-1145 Form

· Check enclosed for the amount of $420.00

· Completed Form I-130

· Copy of Birth Certificate (Petitioner)

· Copy of Birth Certificate (Beneficiary)

· Copy of Passport (Petitioner)

· Copy of Passport (Petitioner)

· One (01) passport-type photo of (Petitioner)

· One (01) passport-type photo of (Beneficiary)

· Completed G-325A and signed by Petitioner

· Completed G-325A and signed by Beneficiary

Evidence of Bonafide Marriage

· Copy of Marriage Certificate

· 1 Affidavit of Bonafide Marriage Letter

· Copy of passport stamps of dates arrived in and departed from India

· Wedding Invitation Card

· Sample chat logs and screenshots between Petitioner and Beneficiary

· Copy of Wedding Ring Receipt along with certified cards

· Selection of Ten (10) pictures that document our relationship and marriage

A few questions I have about this:

1. Is it okay if submit only one sworn affidavit letter? The USCIS instructions doesnt say how many.....

2. For the passport type photos - I mentioned one for each of us...but I am providing two photos of me and two photos of her. Is this okay?

3. In the chat logs and phone convos we have, I have her name listed as "Sumaiya" vs "Sumaiyabegam" Will this make a difference? I was thinking of making a note for this piece of evidence to make sure there is no confusion when USCIS looks at it.

4. I am planning to provide about 10-15 photos of us. A few photos from the wedding along with photos of us together after the wedding. Is this okay?

5. Anything else I can add? I want to make sure my package is okay and trying my best to avoid an RFE.

Before i start the Copy of Marriage Certificate suppose to be in the main pile, with the I-130 form,

that's a must to submit. i read a lot of people forgot to include that and receive a RFE

1 one is fine

2 submit 2 passport pictures of each of you

3 that should be fine, about the name

4 that's fine about the photo's,

5 basically when u go interview, is the time you will need most evidence to show it's a real true marriage

i filed I-130 on 4/25 i sent it out, i got approved 12/9 no RFE for me,

and all i did was send the required papers, everything you sent, EXCEPT i didn't send No Evidence of Bonafide Marriage

i didn't send nothing to show as evidence,

and i got approved.

i think you have enough stuff at this point to send in,

Regarding your list, if you include a copy of your birth certificate, then you don't need a copy of your passport (works in the inverse too). I noticed you wrote "petitioner" twice for passports, I'll hazard a guess and figure that you meant to write beneficiary for one of those. Copy of beneficiary's passport is not needed at all.

Answers to your questions:

  1. Sworn affidavits are not required. If you do choose to include the one you mention, it will carry little to zero weight in the totality of evidence.
  2. Shouldn't be an issue.
  3. Make your note
  4. There is no magic number as to how many pictures are ok. Select however many you feel make the most compelling case (i.e. quality over quantity).
  5. Nothing else that you don't already have listed.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

10. Wedding cards from your side and your spouse side.

That's all I provided got approved without an problem.
