accusing your ex that he comiited fraud doesn't mean that he comitted so. since, you already divorced him and you did your best to get him deported why you still care. he still can file a waiver. the uscis officer told you he will interview him that means they need to hear his side of the story. Even if the waiver got denied your ex can still fight it in court and it's up to immigration judge to decided finally. He still can file a new petition with his new USC, he will be questioned about his priror marriage but he still can get approved. My advice, Just move on. keep chasing your ex news won't get you any where.

To the OP: you did what you could, grow up and stop worrying about things you can't control. Your ex is your ex you have no say in who he can or cannot marry. Just because you don't approve of her weight or age doesn't mean that he doesn't love her, maybe she does something for him that you never could. Either way it's none of your business.

The fraud has been confirmed by the USCIS. My intent is to understand in this specific situation how the USCIS goes about with the 2nd marriage.

I believe that he will not get his permanent green card. He married you, you divorced him, you reported him for fraud now he married an obese old woman....I don't think USCIS is THAT stupid lol

And yes, you should get him out of your mind...he's not worth it!

Some people miss the part where I said that he has been confirmed to be a fraud by the USCIS based on my evidences, so just trying to figure out how this confirmation plays against his 2nd marriage and if it will.

To the repliers: I want to specify again that it is not just me who accuses him of fraud. I provided extensive info to the USCIS including his concealed previous marriage back in Russia that he did not even mention about in hi papers and to me, so it is the USCIS who (with my help) confirmed that marriage fraud was committed. At this point it isn't just me anymore. I am trying to understand how this will play against him when he re-applies all over again from scratch with his new wife. Also, I mentioned that for his I-751, he has no joint evidences with me, so even if he files the waiver, he has nothing to submit it with. Whose going to approve him just by the I-751 application by itself and the max he could provide are affidavits, so that I-751 route through our marriage is blocked for him, not to mention that I accused him of fraud. I think the only way for him is to get approved through his new wife, but then there's the fraud situation, so this is what I am trying to understand how that will play out and at which point he might get denied. I've been in touch with the FDNS officer for a while now and gradually had sent him evidences. I know it is unusual that they get directly involved, but it is the case in this situation (luckily!). Getting married 2 weeks prior to the expiration of his green card with me and to an older woman must have raise issues for him, wouldn't it?!

When it comes to what is appealing to another , it is sometime hard to calculate. I knew a GQ model type that came from money and he wouldn't look twice at anyone under about 250 pounds. He liked the jelly rolls as he called them. And he had the looks and money to get any woman he wanted.

When it comes to someone with a reported fraud getting to stay after a second marriage. It is doubtful that it will pass without a lot of investigation. But stranger things have happened. ( I know someone that was a polygamist that managed to get his N400 approved with over lapping marriages )

This will not be over quickly. You will not enjoy this.

You reported what pertained to you and him as you should. Of course he will be more closely scrutinized.
Sorry this happened to you but you have been divorced for 10 months now and after almost a year don't you think

it is time to move on from trying to control or monitoring the situation ?

It is being handled and you are wasting time and energy to 'understand' the process. No one can foretell what will happen.

Let it go. Live your life. Refocus. Wanting him 'punished' is negative energy. It is now out of your hands. Accept it.

Until you couldn't care less you are still emotionally entangled and attached. Cut the cord.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I think one of the primary goals in our life is to live life happily as possible.

That SOB that caused pain in your life will pay bad karma dues at some point.

The new fiancée will also learn this soon enough.

Besides he's going to be under the microscope and he's US visa chances are pretty slim.

That said, I would completely forget about him. The more you engage your thought about him,

the longer you will drag pain in your life.

Your ex can still deny all the allegation and the uscis are not stupid, they understand how impatient women can be so jealous and try to rope their husbands. USCIS has nothing to do with your ex concealed previous marriage in Russia. They would throw it out of the window because even Obama would not sponsor them to go verify ur prove in Russia.

The innocent woman that u called Obese can do everything to make the USCIS believe that all your allegation are false and out of jealousy............I am speaking from experienced... Your ex would definitely get approved again.....

So are you saying that when the FDNS officer tells me that fraud was confirmed, that there isn't any? Also, so if I saw the photos on Facebook then I am going to get charged ? )) Everything will be used against me such as what? Like the load of documented hard proof that I presented to the USCIS that my ex got engaged in a marriage fraud? That he also got busted for lying to the judge to get a fake restraining order against me not having seen me for a year? Being in the same team with a woman who trains immigrants from Russia in how to claim false abuses? This is all documented by evidence, not just a blah blah by me to the USCIS. So the ex can deny anything he wants, but there are hard evidences, so not sure how much of his denial will work considering that he abandoned the marriage moved overseas tried to offer me money so that I would cancel our divorce for his green card? Any questions?

The reported him and fraud way before he even married. He married recently, but was reported by me almost a year ago, so his wife has nothing to do with me being jealous when she did not even exist at that time when 1) I reported him; 2) when the USCIS confirmed it was fraud. The wife can not take me anywhere unfortunately for her and you s you seem too excited about someone committing fraud.
