Hi Everyone,

My brother wants to bring his daughter from the Philippines here in the US. She was born there and my brother is a US citizen. She is turning 4 years old this month. What are the requirements and the step-by-step process?

Your help is greatly appreciated.

First issue. Is he named on the birth certificate as the father?

Second does he meet the requirements to pass on US citizenship to the child?

Third, is the mother willing to sign a legal document allowing him to bring the child to the US?

The CRBA has to be filed abroad? In our case in the Philippines?

Yes, it is a Consular Report of Birth Abroad. If she qualifies as a US citizen through birth by virtue of your brother being a citizen she must obtain this. Then she applies for a US passport. If she is eligible for US citizenship she will not be issued a visa as no visa is needed for a US citizen to travel to the US.

If the child was born out of wedlock, is there anything the mother needs to do during this process? Do we need to obtain information from her for this process?

He's been USC 22 yrs , child is only 3 yrs

as long as he's on her BC he can get an

approval from mom for child to travel, he

should go there and get the child with no

problem with proofs and agreeable proof

from mom to let the child leave.

Sorry -- not quite accurate. A person can be a U.S. citizen all their life, but if they have not met the requirement for physical presence in the U.S., (sounds like in this case that would 5 years total, 2 of which were after the U.S. citizen was 14 years old),they do not transmit that U.S. citizenship to their children.

If the applicant's CRBA has been approved, will they give the applicant a social security number? Because when we try to apply for a passport online it is requiring for the social security number

While you might be able to fill out the application form, you can't actually apply for a passport for her online -- the passport must be applied for where the child is, so it must be applied for in the Philipines. For a minor child, the application will require both parents' signatures and proof of their identity that matches the birth certificate. (You didn't respond about your brother's name being on the BC -- if it's not, he can still move forward with the CRBA application, but the Embassy will likely require DNA testing). The child will have to attend the passport/CRBA application interview. The Embassy will tell you at that time the process for the SSN and how to handle the passport application in that regard.
