My wife is a US Citizen and she is the primary sponsor on I-864, and I am a international student on F-1 visa.

We are ready to send our package (I-130 and I-485) but our current situation is a little bit tricky, and I want to ask for some advice.

Due to my education, we are living apart; she is in California, and I'm in Ohio.

We do have a co-signed apartment lease for joint tenancy in California, but not in Ohio where I'm studying.

So, the question is, where should we send the package from?

We first thought California would be better since my wife is the USC and the primary sponsor.

But then we heard immigration offices in CA are slow and picky because there are just too many applicants from the state.

Also, I'd have to fly out there during my study just to go through the biometrics, which could be very costly.

So, we are now leaning towards sending the applications from Ohio.

I don't really see a reason not to other than the fact that my wife does not reside here.

What should we do?

Also, this could be a dumb question but do we have to specify (like in a cover letter?) USCIS where to send the receipt, NOAs, and other letters for us? Or, do they just see where the package came from, and have everything sent there?

Please help us!! Thank you so much.

I will just give you my opinion, as I CANNOT, answer all your questions, with what to do with USCIS.

The petitioner is in Calif., to me that is where the paperwork needs to be sent from.

And at least the """BIG""" one for me, personally, "I would stay away from the Vermont Service Center,...,and would lean strongly to the CSC.,.,let me repeat, this is just my opinion, as more ofter than not CSC.,,..,.IS far quicker than VSC.,,.but it changes from time to time, so who knows for sure.

One thing is for sure, I do "think" the address from the petitioner should be used, and endure the expense, as far as you traveling for an interview, my wife and I were just approved AOS.,.,.,.,no interview, no civil surgeon! But, we went through VSC, and was 10 months and 4 days for a K-1.,.,.you have some hard decisions to make, but I wish you the best of luck.,.,.and do what the "experts" on this site suggest to you!

There was a part of question for petitioner/primary sponsor information on I-130 such as residence domicile, take a look at one more time on instruction(I-130) if what office field address you were to send

An I-130 concurrently filed with an I-485 is sent to the lockbox in Chicago; whether you send it from Ohio or California is irrelevant.

And once it is sent to the Chicago Lockbox, it is quickly checked over to make sure the correct forms are in the package, then sent off to a service center. I'm not sure which ones do Adjustment of Status petitions, but the California one may be one of them. You can't control which service center processes your petition.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

does that mean they might make us interview in another state other than ohio and california?

i thought interviews were held near the address written on i-485.. no?

I have the same situation. Except my husband lives in St Louis and I live in Columbus OH. What I did was I used his address for I-130, and my address for all other forms. So I did my biometrics at my local office. After that, I just changed the address on 485, 131, 765 to his address, that way we can have our green card interview in St. Louis.

I was an international student on F-1 visa

10/6/13 - package mailed to Chicago Lockbox via Fedex - DAY 0
10/8/13 - package delivered - DAY 2
10/11/13 - Check cashed - DAY 5
10/18/13 - Received NOA1s - DAY 12
10/21/13 - Received biometrics appt letter (scheduled for 11/07) - DAY 15
10/22/13 - Walk-in biometrics successful (Columbus OH office) - DAY 16
11/14/13 - Form i-485 status changed to "Test and interview" - DAY 39
11/22/13 - Expedited AP and EAD approved!! (EAD status changed to "card production") - DAY 47
11/30/13 - Received combo card and two copies of paper AP (weird) - DAY 55
12/5/13 - Interview date updated on USCIS website (Jan 31, 2014) - DAY 60
1/31/14-Rejected Green card because I forgot to mention a previous J1 visa that will require a waiver to apply for an immigrant visa...

WENT BACK TO CHINA TO WORK AND LIVE FOR TWO YEARS, HUBBY STAYED IN THE US FOR WORK.... :crying:
9/30/15-Started IR-1 application
3/20/16-Sent all required materials to NVC
4/18/16-Case Complete
8/10/16-Interview scheduled in Guangzhou, China for 9/6/16
8/18/16-Sealed medical package received (and an X-ray CD)
