Reasons for wanting your spouse in USA

Affidavit of support - Usually lasts until the family member or other individual either becomes a U.S. citizen, or can be credited with 40 quarters of work (usually 10 years).

Both appraisal and prenup needs to be done before marriage.

Hmm, never heard about the 40 quarters so if the spouse does not take employment? As I read the AOS doc it said 3 years or if they leave the USA. You seem to be quite knowledable. I am quite sure in my situation I will be ok but say someone that has met on DIA or some online site then ties the knot...

She is coming in IR-1

I will if at her request go back and live with her in the Philippines if she does not like it here. I just would need to live in a cooler area, Tagaytay maybe? I may buy some land and put in her name or my childs name. Got to be fair too but must have eyes wide open.

Prenup does not need to be translated and is in the actual agreement since she understands English and agreed, her laywer made sure she understood everything in English and native language.

Like you said CYA, make sure you comletely cover the hole. Her lawyer will not be her lawyer when she moves to the US. Her lawyer (that will not be around if divorce happens) and you assume the she understands English.

This has been used in the past:

The agreement was coerced, signed under duress or signed without mental capacity.

She claimed that language barriers prevented her from understanding the full weight and importance of the agreement.

Again CYA. A properly translated prenup can help.

Hmm, yes I am sure that is totally correct, interpretation here is a whole different story. Let me guess you are legally trained and are now bringing your sweetie over, Abogado and Mizzy? Have you tried to expedite or were you out of the influence of the never ending disasters that hit the RP.

We are at NVC stage still waiting for a case number. No expedite it would be nice though, but the ones that are affected by the calamity deserve it. I'll be seeing her in a couple of weeks though, for our 1st wedding anniversary.

Yup too late to translate but we are on a public forum just trying to help others. Remember these when doing a prenup:

- Getting married outside the US.

- Using different lawyers (one for prenup then another one for divorce).

- Marrying someone that have English as second language, - she might understand you, she might understand what shes reading but she does not know anything about US law.

- Lawyer from another country - just like a driver's license, they are only good on countries that allows them.

- Prenup is good for both divorce and death. Even if you have a will, you can not use it to overide a prenup.

Take care of your love ones, you can't take your money in heaven.

I expected a few replies on this post to be more like "Im an older guy who can't pick up chicks so I went to the PI and married one cause I am ugly and lonely". Take no offense but I think that would be a good honest reply for most. I just did it the other way and moved to the PI as many do and found my 'dream wife' and thought I would live the rest of my life there but not so many guys feel comfortable doing so. I would like to have a home in both places actually if I had the resources to do so, and I just may start that process and buy land when I go back to get my family. I heard 90% of the foreigners have left Leyte so there must be some good land deals to be had.

rofl.gif That is hilarious but probably not too far off from my situation. Ok maybe I'm not that old (48) and not that ugly but I have had trouble meeting someone here in the states. I was married for 10 years and lost my wife in 2010. I started hitting the dating scene again last year but after some pretty bad local dates and one failed Russian relationship, I decided to look for a Filipino woman. Me and Ema are pretty close in age, she is 41 and we have a lot in common. I have now visited her 3 time in the Philippines and I would love to move there. Nice climate and you can buy a really nice house for pretty cheap. However I am bring her here to the states to live first. I have a 13 year old son and my 2 dogs. I don't think it would be fair to move my son there. I would like to move there once he is older and moves out on his own.

Oct 15th, 2013 - NOA1 Hardcopy received in mail. Notice date on hardcopy says October 8th.

Nov 13th, 2013 - NOA2 - update on USCIS website

Dec 9th, 2013 - Petition received at NVC

Dec 11th, 2013 - Petition sent to Manila

Dec 19th, 2013 - Embassy receives petition

Dec 29th-Jan 8th-Our first New Year's together.

Feb 23rd- Fly to Manila to be with Ema for the interview.

Feb 27th, 2014 - Interview scheduled. We were APPROVED dancin5hr.gif

Feb 28th, 2014 - Ema does CFO- Passes with flying colors.

Mar 6th, 2014 - Visa in hand and ready to fly home.

Mar 14th, 2014 - POE Los Angeles

Apr 17th, 2014 - Our Wedding date. (L)

Sept 5th, 2014 - Mail package to Chicago

Sept 9th - Package Delivered

Sept 11th - NOA1 Texts and Emails.

Sept 17th - NOA1 Hardcopys received.

Sept 20th - Biometrics appointment letter received. Appointment for Oct 2nd.

Oct 2nd - Biometrics Done!

Nov 15th - EAD & AP approved and on the way!

No interview or interview wavier notice received

Jun 30th, 2015- Received welcome notice and approval.

July 23rd - Ema finally has her Green Card :dancing:

Actually I just ordered a software living trust/willmaker software package, I am still fairly young but yes take care of your loved ones is job number one. Yes she has no clue about what a prenup was before she saw it and had it explained to her in full. I pretty much followed what in my opinion would be what the state I live in (lived in) would follow. At the time before marriage I was more concerned about Philippine family law because I at that time had no plans on moving myself or family to the USA but...just as in love and marriage things evolve.

I will be in Manila also in two weeks. In about a week I think I will be getting her out of Mindanao where she is temporarily staying (I have to make one more family trip and is safety concern) then up to MNL for the exam and all. Hopefully can get an interview date quickly, if not travel a bit and wait and a then a monthly rental in MNL if I can't get in.

You are still young, close to my age also but I have no family commitments here but just want to bring my family here because...

1. I love the area where I was finally able to buy a home

2. I don't care for dried fish and rice more than once a day

3. hmm, not sure but the PI is a lovely lovely place. this does not count as a reason.
