Current status is visitor. She has not changed her status to anything else.

Thanks. For non immigrant visa number and date and consulate issued at should I just put N/A since she doesn't have a visa (nothing stamped in passport or anything).

I may have a big problem, was just looking at the poverty guidelines for the I864 affidavit of support and 125% above is $19,600 and my tax return it says my gross income was $14,682. I'm pretty sure they go by gross income on the I864, how big of an issue is this? Thanks

It goes by total income, not adjusted gross income, unless you are self employed.

What is your current yearly salary? It is over the line?

So isn't total income and gross income the same thing? Net income would be even lower. I will check my tax papers again. I get paid hourly ($11.12)..and get paid for 39 hours per week. Thanks

you need to look at the amount from your paystubs before any deductions. At the rate of pay you stated working 39 hours per week you should make enough. It is based on current income not past. so if you make $11.12 per hour for 39 hours per week for 52 weeks a year you make enough. You need to obtain a letter from your employer and also include some recent pay stubs to prove your income. This is in addition to your tax returns (complete returns) or tax transcript.

I was looking at the income from one state, forgot about the other 4 months, but it's still super close..it says my total income for the year was $19,949. So does this mean I don't have to send any pay stubs or letter from employer? On the required documents it doesn't mention any of that, only the I-864. Thanks guys!

You do need to show proof of current income, either paystubs or a letter from your employer, especially if you have not had a steady job for years. If you are really paid hourly with no paid vacation, you'd have to deduct vacation from your calculation.

I'm self employed now so I only work when I want, my hourly rate is just a wee bit higher though, as you commented I suspected the OP isn't on a salary given that they quoted an hourly rate and oddly work 39 hours a week (sounds like their employer is trying to avoid something by not giving them 40, I don't know what though).
