Hello Friends,

My wife is LPR and I-130 Petitioner. We have to submit AOS forms now. She doesn't have sufficient income to be the sole sponsor for AOS and her father (my father in law) has agreed to co-sponsor. Can you please help me out on which forms they have to fill? I know my wife must have to submit I-864 but I am not sure whether my father-in-law should submit another I-864 or submit a I-864A? please help me out.

it depends if he lives with her in the same household or if he will need his wife's income as well

if he lives in another place he will need the i864

if he lives in the same household, he can use the i864A if he will use only his income, but if he needs his wife's income to complete the poverty guideline, then he needs to use the i864 and your mother in law will file the i864A

Are they financially tied, ie one is dependant on the other in the last tax return? If so, use I-864 for the father. If not, even if they live in the same home, use I-864.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
