Good Afternoon VJ

Want to say Thank You in advance.!

I am in a bit of a predicament and needed some sound advice about my options with my future wife.

Background:

My fiance is from Germany and a citizen there, but moved to Canada on a student visa. She has since lived in canada and her Student Visa has expired. We met after this and are now engaged to get married.

We are looking into doing the CR-1 visa immediately after we get married. Will her expired student visa in Canada pose any issues with US immigration? If it will what is the best course of action to take? She has no family or connections to Germany seeing she has been in Canada for over 10 years, and her entire family has immigrated there.

If it will pose an issue that she is currently in Canada with an expired student visa, what other options are there for us?

While she has no legal active status in Canada, she is a resident. She has a drivers license, and other various forms of ID and mail linking her to a set address.

She's resident in the sense that she is staying there. Having ID does not make her presence legal. She can't interview there without it.

I can explain it to you. But I can't understand it for you.

The Biometrics is done during the interview process (except for a few countries they have to go to a third party vendor). But yes in Germany she will do her fingerprinting at embassy. She can use any mailing address she wants her mail to go to.

You have to go to the approved physicians for that embassy so no you can't do in Canada.

She needs to go home to Germany as she is not legal in Canada. She should get her police clearance before she goes as it'll be easiee but everything she needs to to do needs be done in Germany

I would do a K-1 Visa first. It is a faster turn around time.

Please keep in mind that some dates are only known after receipt of another document.
For example, the USPS Form 3811. The stamped receiving date was not know until the original Form 3811 was received on 07/13/2013 1:30 p/m CST.

Faster doesn't mean better. The beneficiary is illegal in Canada and therefore needs to go back to Germany in order to get a US visa.

Your fiancé needs to be processed in Germany. You can go ahead now and file the petition to the USCIS now. As you are the petitioner you file all the paperwork in the US. Why file for the CR1/IR1? That's for couples who are already married and has a process time of 7-11 months right now.

I would go for the K-1 visa which has a process time of 3-5 months right now. She comes to the US and you marry. Then file for an Adjustment of Status.

She has to interview at US consulate in Germany since she

has no legal landing Canadian status whether U file the

K1 or Cr1, she must be able to have some place to go

in Germany when its close to her medical & interview

even an older relative friends, she'll need to provide the

addresses of all places she's lived since age 16, and should

obtain a Canadian police report before leaving for interview.

Am curious a Canadian may have the answer don't RCMP

request your landing card to process a police record when

a person is still living in Canada?
