Hi- had a previous post that it looks like people have stopped replying to and i am not panicking about this whole thing.

I have an ex bf who is in the military, while he was deployed a few years ago, we found out he was going to be transferred to Kentucky when he returned so, in fear of having to break up due to the distance ... I got everything ready for the k1 fiance visa application and we mailed it off as soon as he returned home.

But quickly after, I saw he had severe ptsd and he refused to get treatment. After he cheated on me and smashed up my car, and still wouldn't get help.. I ended the relationship. It was not an amicable break up. He still hates me for ending things.

We filed two years ago- he's american .. I'm Canadian..

He moved right after- he never got the NOA1.. his mail was never forwarded to Kentucky when he moved.

So we have no receipt number nothing.

Right after I emailed the USCIS 2-3 times asking to have it cancelled- I got no response.

March of this year I started dating an amazing guy.. I'm super happy. We decided to start this process for us to get married.

So this obviously came back into my mind.

I called USCIS - they told me my ex has to cancel it.

I ask my ex.. he says he will but he is deployed and in love with me.

I ask him again- He says he doesn't care to help me at all.. and will not help me..

I'm getting some answers saying that as long as I am honest in the interview stage I will be fine- others say my new application will automatically be declined.

We just got our NOA1..

I'm so nervous that it is all going to be for nothing.

my ex will not help me.. I've tried multiple ways.

I'm so upset. Please help.

There are some VJers here had same problem with yours. Some of them could passed the interview even though they had several petitions still active. Some others, unfortunately, could not go through.

I know nothing about this but probably is better showing to CO the proof that you already asked your former fiance to cancel active petition but he refused it and you can't do anything or pushed him to do what you've asked for. I hope you still have all papers from your previous I-129F in case you need those. Good luck!

There are some VJers here had same problem with yours. Some of them could passed the interview even though they had several petitions still active. Some others, unfortunately, could not go through.

I know nothing about this but probably is better showing to CO the proof that you already asked your former fiance to cancel active petition but he refused it and you can't do anything or pushed him to do what you've asked for. I hope you still have all papers from your previous I-129F in case you need those. Good luck!

I'm going to screen shot the conversation with my ex from Facebook where I tried to get him to cancel it.

I don't have any information from the last time we submitted because he kept all of that. We never got a receipt number or anything before we broke up.

Consular officer from US embassy that will going to interview you for K-1 visa. Yes, I am sure if you have good explanation to them about your situation and give them a proof, they can't stop you from obtain your K-1 visa just because your former fiance refused to do so. I wish could find you the thread on VJ that was talking about pending several petitions. I will let you know when I found it.

I think that's fair grounds to decide not to marry someone.

Having a previous petition could obviously be a red flag, but so long as the relationship evidence is good, it should all work out in the end. Good luck.

By any chance did you write a cover letter with your petition to withdraw the previous petition (just so that it's in their file). I wouldn't worry about it. I think you are find Canada is a pretty forgiving place ya know.

Just be ready at interview to explain good your have screen shoyts of conversation.

And for what its worth you are a brave woman to know a problem head on. I am glad you are posting about a happy new beginning instead of the other kind of post "Help I married my boyfriend who is trying to kill me he has PTSD". So good for you. Stay positive and it will all be well.

Just ignored that user. Probably is a troll to get attention just like some other new users on VJ. Don't feed the troll. I am wondering if he/she really read your post carefully and still don't understand that or pretending don't get it at all. If he/she accepted when his/her fiance cheated and beat him/her a lot and still wants to go to the US, I am highly suspicious he/she just wanted a green card.

Thank you everyone for your words of encouragement. I can't tell you how much it means to me.

I really am hoping that this doesn't completely ruin things for us as far as me immigrating.

If you find out anything new.. please let me know.

In the mean time I am going to send addtional letters to USCIS and The Consulate to further express my desire to withdraw from the previous application.

I don't have a receipt number but... I just want to do anything i can do to make sure I did my due dilegence.

How long ago was u and your ex's thing? are we taking like a year or 2 ago? I believe that the 1st one is good for only a few months anyways. As far as I am aware the K 1 visa expires and then I don't see any legalities.
