I have a question regarding filling up DS-261 form...

In "Security & Background" --> "Medical and Health" section, the second question is "Do you have documentation to establish that you have received vaccinations in accordance with U.S. law?"

Now for India, they don't do medical check-up until we have appointment letter, so shall we answer this "NO" with a small explanation or just say "Yes" and show it during interview....?

A few hours after we submitted our DS-261 online, the AOS bill showed up in my e-mail. So now that's paid, and I'll be sending out the packet tomorrow.

It looks like I'm eligible for the I-864EZ, because even though I have both regular W-2 income and self-employed income, the W-2 income is enough to qualify. I'm actually having a hard time finding a hard-and-fast list of exactly what I should submit, so I'm going a little overboard and including 3 years of tax transcripts, 2013 W-2, and employment letter. If anyone reading this thinks I should add something else to the package, please let me know smile.png

What about the list on post 2 in the FAQ I put together? Please read it. There's a list on what should be included in both packages.

Unless you filed taxes jointly, you don't need the W2s. And in junction with the employment, send some pay stubs.

I answered NO on mine and it was approved, because currently you don't have any documentation to establish vaccinations in accordance with US Law, if you answer yes, and they ask for documents, where are you going to provide them from? Just write an explanation explaining the situation.

Keep in mind, some people actually have the vaccines and documentation to prove it. I did. So I answered yes. NVC doesn't ask for the documentation. It doesn't matter if you answer yes or no for this question. Either answer is fine as long as you're honest.

Hi vjers..i need your help. Im really confused..if we file our tax as joint..is it really necessary that i have an income in my country?what if my income is too low? Where can i get ittn? My husband asked for a power of attorney cause i am not there yet to sign..so does it mean he chose the married filing jointly? Does married filing separately still needs power of attorney? By the way im not in usa yet and still waiting for nvc case number.whats the best option to take?

In your case, it might be easier to do MFS (married filing separately). With that, the USC just needs to write 'NRA' (non-resident alien) on your SSN field. Nothing else is needed; you don't need to sign anything nor send anything in.

For MFJ (married filing jointly), documentation is needed from the foreign spouse which can be hard/expensive for some countries (in Canada it's easy peasy). Then there's the W7 form that needs to be filed and signed by the foreign spouse.

The ITIN is only created if you file for MFJ and include the W7 form. This takes extra processing time.

Your income doesn't matter. I had no income the first year my husband and I filed taxes together. It wasn't a problem.

I am confused... below is a quote from the instructions for I-864 Part 6

6. Annual Household Income.

This section is used to determine the sponsor’s household income. Take your annual individual income from Item

Number 5. and enter it on Item Number 6.c.

There is only one person in my household now. I thought I should leave 6c blank.

If I put the number in and then follow the instructions on Part 6 line 10 and add

all lines it will be incorrect. Thanks for any help

If you go to the USCIS website and download the newest I-864 and the instructions, they are confusing when it comes to part 5 and 6.

The form instructions state to put the current individual annual income from line 5 in line 6c (under Person 1), but on the I-864 itself,

it then says to add lines 5, 6c etc etc and place total on line 10... you wouldn't count the sponsors income twice so it doesn't make sense.

What's the correct thing to do and why are the instructions contradicting?

Thanks darnell for the info. I actually went to congressman's office yesterday and spoke with the immigration staffer. I gave her a copy of my approval notice and talked to her what's going on with my petition. She will get back with me as soon as she hears anything but she'll definitely follow up on the case since I gave then an authorization to intervene. Hoping I will get anything by next week.

Uh-oh. I think my husband filed jointly (just a couple of days ago) and his dad helped him fill up the forms and stuff. They just asked for my tourist type and visa number. I know he mentioned something about needing me to sign something that he'll email and I'll scan back to him after signing.

What additional documents do we have to add to the AOS package or bring with me to the interview?

Filing tax returns with the IRS and dealing with immigration are two different things.

You still have to file taxes with the IRS correctly though...

And 2013 tax information won't be required at NVC or the interview until after the tax deadline of April 14th.

W2s aren't required until the petitioner filed jointly in which they need to include W2s to show their own income.
