I noticed that question about: "What if I (the petitioner) live with my spouse in their foreign country? Do I need to include anything in either package?"

I am the original petitioner (for the I-130) but my parents will be doing the AOS(I-864) and they will be providing the domicile. Do I need to fill out the AOS (I-864) and have my parents be a sponsor or should I just have my parents do the AOS?

It is a bit confusing to me since most people are separated when doing the IR-1/CR-1.

For the AOS package,

From the IRS, I received "Account Transcripts" & "Return Transcripts" for 2012, 2011, 2010

Do i send both types or one type?

&

Can you email (pdf) everything to NVC for the AOS package or does it only have to be mailed in to NVC?

Thanks

Kevin & Amanda =)

I noticed that question about: "What if I (the petitioner) live with my spouse in their foreign country? Do I need to include anything in either package?"

It is a bit confusing to me since most people are separated when doing the IR-1/CR-1.

I (beneficiary) am living with my husband(petitioner) in Japan, and his parents will be a joint sponsor.

My understanding is, that petitioner still need to fill I-864 and submit evidence of domicile.

Whether you are living with your spouse in spouse's country or not, I think filing process is the same.

Please correct me if I am not right...

Just to confirm.... It doesnt matter if you send the IV before the AOS does it? Both fees have been paid and I now have everything I need to send the IV pack. My wife is waiting for 2013 tax returns so she cannot send the AOS for another couple of weeks.

Many thanks

If the case is sent to the NRC instead the USC needs to contact the USCIS and speak to a tier 2 to find out where the file actually is and request it to be sent ti the NVC. There is multiple topics on this and solutions if you do a search. Darnell has several posts on the situation so you can use him in your advanced search.

I also suggest making a normal post about this so it's not lost in the shuffle of an NVC thread.

It is a bit confusing to me since most people are separated when doing the IR-1/CR-1.

the petitioner (person signing the I-130) is the primary sponser and must fill out an I-864, even if 0 vaues for petitioner's income and assets.

Since the petitioner is not in the USA, must to prove up re-establishing domicile as well, submitted with the I-864, or a letter stating you'll prove up on interview day
