I'm really stressing out here and need some advice. I am going to be filing for my hubby of almost 2 years pretty soon. We are just getting all the paperwork together. But, I have a history with immigration, so I'm nervous. I've been married twice before, both times to Mauritanians. I filed for both of them, the first got his green card, the second did not because we split. Divorce to new marriage was only months apart and I was married to both for 4-5 years. Now I'm scared to death immigration will not allow my hubby to come with me. I thought about writing a letter to attach to the I-130 explaining my situations, i.e. marriages and divorces.

What do y'all think?

So basically you only successfully petitioned one person. What happened to the second one - in the US or not? Explain it in a cover letter. Don't forget to include ex-husband's info come Affidavit of support time - unless he naturalized or worked 40 quarters (10 years), you still have to include him in the count.

I don't know where either of them are. Probably in the US, but the 2nd one got denied. He was going to try to perdition a different way, but I haven't spoken with him in a long time, so I don't have a clue.

For the Affidavit of Support, my mom is going to sponsor my husband since I won't have a job until after we are there. Do you think that is a problem?

With your history it will be an uphill battle. Be prepared with a lot of supporting evidence, and explanations of what went wrong with the others you petitioned. How long after your last divorce did you get remarried to this husband? If it is only a few months( not sure which marriage you meant), it is another red flag. Is the country of origin Morocco like your profile says? If so they are one of the most difficult consulates to go through, it's a very high fraud country.

Hi thanks for the reply. Unfortunately, it was only months between both divorces that I got remarried, well the legal divorce. Islamically we were divorced for about 6 months (from the 2nd husband). I'm hoping that because I live and work here, have a house and I even have the Moroccan version of the green card, that it won't be so difficult.

I suggest you write a letter of attestation on each marriage/divorce, include it with the I-130 and reference these letters in the cover letter that yer prepping.

You've two red flags - if you want to overcome them during the USCIS adjudication phase, you'll need to write stuff, include it with the I-130 submittal.

Yes, this means you're going above and beyond the 'just fill in the forms' instructions.

DoS/IV Unit will not overturn, as the red flag was already addressed and the petition approved based on what was submitted.

Sort of a catch-22, but in a good way.
