My mother in law came back from China to visit. We've had twins and she has been here A LOT. We picked her up from the airport tonight and found that her entry was granted for only 30 days instead of the customary 180. I spoke to the issuing officer and she was kind and explained that my mother in law had been in the US very frequently and for long durations. She was considered an immigration risk.

So, I understand, but my mother in law is NOT going to immigrate. I can file for a visa extension, but that may just tick them off.

My questions to the community:

How serious is this?

Should I apply for an extension?

Should I lawyer up?

Should I call congressman and beg?

Should I just send her back in accordance with the 30 day limit and then let things blow over for a few years?

What do you advise?

hi

no, she should leave before the end of her stay. she's lucky she got at least 1 month, she is coming here for too long and too soon, and not come so often or they will take her visa away because she is more here than in China

You don't have anything to do with her tourist visa. Your inquires may just be what causes them to review how many times she has used and abused the visa which may cause them to revoke it. You have already been warned by the officer.

She can attempt to extend but it would be far better to just go home and avoid returning for quite awhile.

A lawyer couldn't help her change the circumstances she has created however they may be able to explain the problem is terms that would be acceptable.

Congress has no influence in these cases. She isn't even a citizen which is who they represent.

I have a similar question...

I am a USC and my wife is Chinese. We never plan on living in the US but we regularly want to go back and visit every 1-3 years for 4-6 weeks. Hypothetically if we get approved this first time and try to reapply every 1-3 years, do the chances of receiving the visa decrees going there that often? Just wondering if this was considered often like this person's mother-n-law.

Visiting for a couple of months every few years is NOT frequent travel. You should have no trouble with your plan, Mitch. Besides, your wife, if approved, will likely be granted a 10 year multi-entry visa anyways.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If your mother has been repeatedly visiting for 180 day periods they probably suspect she is babysitting for you and working illegally. If you request an extension you can almost bet that she will not be allowed back to the US for the next year and will not get another visa when this one expires. Lawyers and congressmen can not change immigration law and your mother has been pushing her ability to visit to nearly living here. Lawyers and congressmen can help with stuck petitions but they have no power to bend the rules. Your best thing is to accept the 30 days , enjoy them to the max and have her visit less aggressively in the future

This will not be over quickly. You will not enjoy this.

I offer something else.

If your wife is now a USCitizen,

then SHE can file for an adjustment of status on her mother (I-130 + I-485 + monies, other forms and a medical exam) . That'll keep the mother's status 'legal' for all of 2014.
