Well, finally logged in and created an account. I have found a great deal of the information useful here but I have just learned something that may jeopardize my entire case: Apparently the new legislation in the Philippines requires that the father's consent to get the K2 visa for my fiancee's' child. Now, here's the catch: the father's consent is required even though they were never married. I may have to move to the Philippines.......serioulsly.

The fathers approval is required in most countries...if not all countries. It doesn't matter if they were married or not....he is still the father.

I had to get permission from my ex husband to bring my children to US.

married Dec '03 in US

Feb 04...... I 130 filed......................approved August 04

March 04... I 129F filed....................approved October 04

August 04...I 130 for children filed....approved September 04

I think your fiancee should talk to the father of her child about it so that when you start processing your K2 case, he will not be the burden for the papers of that kid. But since they were never married, it means that the child's surname is your girl's surname so that means the father cant do anything about it.

I just wish you luck in your visa journey!

As far as I know it's not a new law, as I've seen many times before that yes, you need the father's consent to get your child to move to US with you.

1. Make sure his name is on birt cert. If it is not no problen

2. Prepare a small ($200 to start) gift for the fathers signature on docs.

3 This is NOT new legislation. Been that way a LONG time. It just makes sense that a lady should not be able to take a child away w/o other parents consideration.

4. See rule 2 and increase if necessary. He will sign.

1/27/2007 Nerissa told me she received a ltr on Friday 26th from USE in Manila telling her they had our petition. I'm sure that's a GREAT thing.

She said YES!!!!! We are back in the med/interview schedule. After a few months I realized I couldn't live without her. I wooed her back and now she is coming to USA after interview.

we just received K-2 Visa from Embassy in Manila. father was not mentioned. requirements for travel clearnce for a minor from Philippines,

This is a new law that applies to illegitimate children. It has either been passed or is coming before the legislation.

I would think the US government's requirements for bringing a child into the US and the Philippine requirements for taking a child out of he country are two different and independent things.

Did anyone really think that one parent would be able to take a child out of the Philippines without the consent of the other parent? Why would anyone assume such a thing?

CAN A TRAVEL CLEARANCE BE ISSUED TO ILLEGITIMATE CHILDREN WHO ARE STILL ARE APPLYING FOR THEIR VISA IN THE EMBASSY?

Illegitimate children are under the custody of the mother. If they will be traveling with the mother, they are not required to secure a travel clearance from the DSWD

You've hit the key point: Illegitimate children are under the custody of the mother, but the new law requires the father's approval to take the child permanently out of the country (as in K2 visas).

I think you can bring the child without the father's consent if your not married and haven't known about the father's whereabouts... Thats what the lawyer told us, and yes you need to get the father's consent if you know where he lives and how to keep in touch with him. I don't have much of info's about this but I will try to help and ask more about this matter to our lawyer he haven't given us enough info yet, and I am concerned about this issue because I too have a daughter and not married but I haven't heard from my daughter's father... I am hoping that we don't need to get his signature and consent with this matter. If there's anybody else who can share about this post every help is appreciated... MERRY CHRISTMAS :)

I was told by my lawyer that if the fathers name isn't on the BC then the father would have to prove paternity before the child could not be removed. If the name isn't on the BC who would you need to get permission from? All you have to say is the father is unknown.

oh what if I couldn't find him anymore, what if He doesnt feel to cooperate?

so it means He holds the future of me and my child?

Everything was under His control? GREAT....

afterall..... he wasn't suporting you & your child but still everything was in His hands.
