K1 visa in process and pregnant?

Hi

K1 visa petition sent but since baby not born couldnt include it. Does anyone know how this works?

Im the benificiery, living in sweden and pregnant. My fiance is american and sent the petition like a month ago. How does this work? What do we need to do when baby born in february 2014? Can we add the baby or we need to fill out a new petition for the baby?

Additionally, if the child is / will be a US citizen then no visa can be issued to them (since none would be required).

I dont know if the baby become a us citizen only cuz the father is since we not yet married...

Yes, the baby will be a USA citizen and you will file for a CRBA (check the VJ guides) which will authorize the baby to get a US passport. No you will not have to start over!

Since the father is a US citizen, the child can generally acquire US citizenship, despite being born abroad. There are a few 'conditions' listed in the link below.

"A person born abroad out-of-wedlock to a U.S. citizen father may acquire U.S. citizenship under Section 301(g) of the INA"

Assuming the child's mother is Swedish, the child can hold both Swedish and US citizenship.

You can message me if you want. I had my kiddo in sweden before my visa was done so I went through the process of getting her a dual citizenship. Its quite a hassle with all the paperwork but if you have it all together by the time the baby is born you will have a interview time at the embassy pretty fast and the baby's passport will arrive rathet fast too. Remember that the baby must travel on the american passport and not a swedish one.
