Hi all,

please i need advice on what to do?

I was on a student visa prior to marrying a USC just 3mths ago.

All petitions sent in. I-485, I-130, I-765, and I-131.

Notice of acceptance was on Nov 27, biometrics dec 30th2013.

Dilemma!!!!

I want to leave this man on grounds of abuse and infidelity.

I really could for go everything and just walk away but I've worked hard to come to the US to study and hope for a career. and i dont want to jeopardize that.

please what advice can you give me. i cannot afford a lawyer!! and he's so stingy

I'm basically in limbo.

how can i get a legal status preferably residence permit if i separate from him before i receive my EAD and before interview or green card.

is it easier to wait till after i get my green card before leaving. but i risk being called a fraud cos he's mean and vindictive!!

If you don't have a viable marriage you have no cause to adjust status, to continue would lead to a life time ban for misrepresentation.

If you have documentation of the abuse you could file for vawa ( based on abuse) filing a false vawa claim or fling fake police reports would also lead to a lifetime ban. If he has truly abused you then you should read up on VAWA.

This will not be over quickly. You will not enjoy this.

Consider getting a divorce and keeping your student status, so that you will not have problems with the USCIS.

Then you have only three options, none of which are great:

(i) depart the US and return to your home country of origin.

(ii) file a VAWA case if you believe you have one.

(iii) try to reclaim your F-1 status (this option is only available under certain circumstances).
