My husband originally arrived to the US under a J-1 visa. We met, fell in love and recently married. heart.gif

We are currently filling out all the required paperwork for the USCIS (I-130, I-765, I-864, Biographical forms....and the lovely I-485). Of all the Forms we are completing, the only one we have a big question with falls under Part II (Application Type) of the I-485. We sought advice on "Just Answer" and honestly, I do not feel it is correct. We are receiving conflicting information for several sources, and I was curious to get input from those who have been in (or are in) a similar circumstance.

I am a born US citizen, which is why I do not feel like we would fall under Box 'b.' However, we don't feel like we fall under Box 'a' either. We are just struggling with what to select to ensure we don't get delayed (or denied! sad.png)

Anyone willing to share some personal (or professional) insight that might relate to our situation would be sincerely and greatly appreciated!

The answer is A, because when I 130 is approved it will give visa number immediately available. As the guides suggest you submit both forms concurrently ( I 130, I 487, etc).

Just make sure he doesn't have two years home residency requirement with his J 1 visa.

4/12/13 - sent I-485 package

4/15/13 - USCIS Chicago Lockbox received package

4/22/13 - got email and txt

4/29/13 - received NOA in mail

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived

06/02/2016 - NOA date

06/24/2016 - biometrics appointment

11/28/2016 - interview scheduled for January 9th, 2017

01/09/2017 - interview passed

01/20/2017 - Oath Ceremony

Everyone -- THANK YOU for sharing this information. We assumed it was 'A', but after receiving the information from the immigration attorney from JustAnswer.com stating to select 'B' we were confused. That has since been cleared up, and your replies make me feel much better.
