Hello everyone, I am new here.

My goal is to get my new wife permission to return with

me to the USA. We are married and live in Colombia while

we wait for her papers. I am a US born citizen.

After searching the UCSIS and other web sites I am confused.

Do I need a i-130 AND a i-129F form or just the i-130 form?

I've filled out the i-130 (and g-325a's) and am ready to send them in.

I have read conflicting things. The i-130 instructions does not mention

the need for the i-129F form, but this and other web sites say it is needed.

I simply want to get permission for my wife to enter the USA. Once

we are there we can file other papers and wait for other immigration

classifications, etc...

What is the fastest way to get her into the USA?

Thanks so much for any help, and congrats to all the peeps here who are

getting their visas!

Happy Holidays!

Yes you first file the I-130 for as if for CR-1 or IR-1 visa then when you get the receipt from the I-130 (NOA1) you then send a copy of that along with the I-129F and another set of G-325A forms to start a K-3 visa.

I-129F all by itself is for K-1 fiance visa.

Are you a resident of Columbia? If so, Direct Consular Filing of the I130 may be the fastest option if that is available in Columbia.

As YuAndDan said, I129F for spouse is optional.

Good luck & Congrats!

Thanks YuAndDan,

I sure appreciate you help.

Did you have to prove your income beyond providing Fed income tax forms?

If you needed a letter from your employer, did it need to be notorized?

Merry Christmas

After I am married for 6 months I could file through the embassy here, but they "bury" you in paperwork rules

and all the docs need to be notarized X10. Notarized copies of birth cirtificates, etc... I would have to fly

back and forth to the States to collect all the apostilles and notarized copies, it is insane, their requirements

at the embassy.

I'm still confused. Do I need both the 1-30 AND the i-129F? or can I just get buy with the i-130?

Merry Christamas!

Merry Christmas

Depends on which visa you do decide on, K-3 or K-1 visa uses I-134 form at the consulate, and the only thing needing notarizing is the I-134 form itself. If doing CR-1 visa the you would be using I-864 form and with that form none of the financial evidence including the form needs notarizing.

If your income is well above 125% of the federal poverty guidelines for the past 3 years then the only financial documentation needed will be tax transcripts. You can include a letter from employer if you feel it helps your case.

Merry Christamas!

Yes you can just file the I-130 only, it may take a little longer to process but you will have the big plus of having your spouse enter the country and receive a green-card shortly after arriving. The other method I-130, and I-129F adds the complexity of having to adjust status here in the USA in order to get the green-card, this process can take many months to a few years.

See the compare table to see the differences of (I-130 CR-1) and (I-130+I-129F = K-3) visas. http://www.visajourney.com/forums/index.ph...mp;page=compare
