Hello Everyone.

I am doing some research for my friend who is engaged to an under aged girl. He is trying to file for the K1 visa and my question is can he file for her now that she is 17 and have her parents sign off on them being okay with this? Or does he have to wait until she turns 18 then file for the visa? Any help will be appreciated.

There is nowhere in the I-129F instructions that states to be eligible you must be at least 18. One requirement is that you both must be legally able to marry. You need to know the laws of the state in which you will marry. Check with your state and if parental consent is what is needed for a 17 year old to marry, then you provide parental consent with your I-129F and include an explanation of the laws of the state where you will wed to show that it is legal. There is no categorical exlcusion for those under 18. But you must obey the laws of her country, of your state and of the Federal government. One of those laws says it is illegal to travel to a foreign nation to have sex with someone under 18.

How soon does she turn 18? You would make your life a lot easier if you waited until then.
