Hi i have a concern, please help.

Our lawyer sent back the rfe document which is a pasport pic only to CSC on may 9, Then

My question is,

Is it possible until now MAY 20. there's no notice yet? Like they should update us that they already receive the rfe and its for reviewing something like that?/

Finally got my RFE hardcopy today May 22. The date on the website that they said they mailed the RFE was May 14 and this was also the date on the RFE I-797E form as well. The letter was postmarked May 20. I have an axe to grind because of the difference between the alleged mailing date and the postmark date, but will deal with that at another time.

Here was my RFE -

REQUEST FOR EVIDENCE:

INTENT TO MARRY: The petitioner and beneficiary must each provide an original statement (signed and dated) indicated that they plan to marry each other within 90 days of the beneficiary's admission to the the U.S.

PHOTOS: Submit a passport-style photograph for the beneficiary, [name]. The specifications are as follows:
- Glossy color
- Plain white background
- Unretouched
- Not mounted
- Full frontal facial image
- About 1 inch from bottom of the chin to the top of the hair
- Taken within the past 30 days

So I think my "mistakes" were not sending sponsor intent to marry signed notice and/or personal letter (the instructions I had said just to include beneficiary intent to marry notice and personal letter), and I think the passport photo of my fiancee was professionally retouched by looking at it.

I'm still a little vague on the scrutiny given to passport photos and what sponsor intent to marry letter(s) they are looking for, so any advice or feedback from folks who had similar RFE's would be very welcome.

I have RFE's on the brain now.

Looking through my copy of everything last night I noticed a couple of things that may well provoke an RFE. Trying not to worry too much, will just have to wait and see when the time comes. ClockWatch2.gif

There's specific info which is missing/incorrect (although repeated numerous times elsewhere) but also I was wondering if the fact I fly into an airport not located in the city where Bob lives might be a problem, too?? His city airport is rubbish and never has flights which are of any use to me, so I come into the next closest and he picks me up. Additionally, he always flies *from* this airport, too. I'm wondering if this fact (shown in his boarding passes etc; both of ours name said airport (Burlington International)) might bother anyone reviewing the application?? Hopefully we have enough additional evidence if needed.

...I think I maybe need to take some deep breaths and step away from reading up on the process for a while unsure.png Sometimes I think it stresses me out more! Our anticipated adjudication time isn't until between August 29, 2013 and September 2, 2013 so I think perhaps Jo just needs to chill out and enjoy her summer! headbonk.gif

My RFE was because I did not send in a letter of intent from my fiance, only one from me. I had hired one of these "I will help you and guide you every step of the way to your visa approval guys. Before I sent in the application, he had me email it to him to check for errors. I did and he wrote back that everything looked good. Then I got the RFE for no intent to mary letter and when I wrote him and asked him why he did not pick up on this, he said he never heard of the beneficiary being required to submit a letter of intent. That caused us a delay that should never have happened. He is the one that was the self professed expert. This guy took my money and when I would email him with a question, he would either ignore it, or answer me with a "smart ###" answer. Talked very nice to me until I paid him. If I had known what I know now I would never have hired anyone, especially this guy. I know that I could have done it without him. The guy I hired was ezvisa.com.

We already got our NOA2 hard copy.

we got and RFE asking for a LONG FORM of my fiance Birth certificate, and more evidence, as passport stamps and boarding passes, we sent all that and... like 10 days later we got approved!

About the letter of intent must be 2, one signed by the petitioner and the other by the beneficiary, ORIGINAL SIGNATURE.

I use the same letter as the friend posted here. make sure you change the address, names and Date!! (after the NOA2, for the interview; you will need the same letter of intent, just from the petitioner, with the address of the consulate where the interview is gonna take place, and with a new date, and of course original signature)

About the pictures, just go to Walmart or any place like that, ask for passport pictures, they know.... and are ready in less than an hour!

Our RFE also requested a signed letter of "intent to marry" from both of us. Trouble is - we already submitted it with our original application (via a lawyer). We sent a notarized affidavit of a statement of our relationship, signed and dated by the petitioner (my fiancé) stating that we were planning a June wedding (Hah! not happening now because we have been waiting 6 months for them to get off their backsides and look at November 2012 filers) and a signed and dated statement of relationship from me (including the part where we intend to marry as soon as I enter the US). These letters were both signed in blue ink (to show clearly they are original) and dated but whoever processed the application didn't bother to read the documents we sent.

Hence a completely UNECESSARY RFE and delay now.

Our lawyer sent a stinking letter but also got us both to sign new letters that only had INTENT TO MARRY info on them to make it perfectly clear: Copy below.

These newbies they brought in to help process the backlog in CSC lately probably have a checklist to work off and maybe because they didn't see an acutal document called INTENT TO MARRY, they assumed it wasn't there and didn't read all the documents they DID have. So I would recommend spelling it out to these people and leave nothing to chance. We already moved our wedding plans back from June to beginning of August but this is now not likely either thanks to CSC incompetence.

Our hard copy of RFE never arrived in mail! They didn´t take the case before it was 15 days from the note of the RFE. When we called after 14 days, they wrote the case down and told they will resend the hard copy of RFE.

After about a week we finally got the hard copy of RFE. They were asking one papers, that we already sent them! They wanted certified paper and we sent it few months after we sent the 129 petition, because we knew they would ask them. Obviously those certified papers never found their way into the original application package even though we got the note that USCIS got the papers and scanned them!

Well anyway, luckily it was easy fix because we had those papers at home (took extra ones) and we just needed to resend them. 8 days after papers arrived to USCIS we finally got NOA2 yesterday! So exactly 6 months after we sent the 129 package :) We are happy :) But yes, sometimes you can get RFE from something that was allready done or done correctly, but they for some reason don´t understand it or what ever....

Do RFE's require originals, or are photocopies of documents acceptable?

I got a notification that an RFE is on it's way. I'm 90% sure it's going to be about the "letter of intent." Since my fiancee and I are in China, and the RFE is going to my mother's address in the US, can we just scan our signed letters and have her print copies to give to US-CIS? I'd put the originals with the packet of other original documents I have waiting for the visa interview.

2013.1.7- I-129f mailed to Texas Lockbox (with correct fee this time--> Delivered 2013.1.8 (priority date)

2013.5.29- RFE mailed--> 2013.6.3 RFE arrives --> 2013.7.3 Forms mailed back to CIS via DHL--> 2013.7.5 CSC confirms receipt of evidence

My fiancé and I hired an immigration lawyer. We don't think our petition will move along faster because of this, it is an option that works for us. My fiancé is out of the country every 6 months for a 2 month period, and in and out of the country for up to 2 weeks at a time otherwise- so we thought a lawyer would be helpful if he wasn't in the country when things were approved (If that makes sense).

I was just reviewing the copy of our I129f as a friend of mine is just about to go through the k1 process herself. I noticed that his letter of intent isn't dated. I am wondering if he should resubmit a dated letter of intent, or should we just wait for rfe?

I would like to know, in case of receiving an RFE, how much tine it should take from when they send it untill they give uou an answer saying that what you sent in enough.

For example: i think i sent the wrong passport pictures (as far as size) so i think I will get an RFE.

How much time would the RFE delay our approval if i sent them the pics right away?

I scanned through the thread, and didn't see this one posted yet, so I thought I'd add it to help those in the future.

I received an RFE for a divorce decree, which seems basic enough, but my mistake was trying to use logic instead of just doing what I am supposed to do blindly.

See, I've been married twice previously. Of course to apply for my 2nd marriage license, I had to show my divorce decree from my first wife. I did this and they gave us the license. Well I figured that knowing you have to prove the previous divorce to marry the 2nd time, that my divorce decree from the most recent marriage would be all they would need. Apparently that is not so. The only thing they wanted for my RFE was a legilble copy of my legal divorce decree. I went down to the state office that has them and got a certified copy and sent it off straight away.

I just thought I'd add it here so anyone else in the future may see it before filing and be sure to send in copies of all divorce decrees. At least my ignorance might be helpful to someone else down the line.

Good luck with your RFE my fiancé received one Dec 2012 its been sitting with at Vermont Centre since February and we are still awaiting a decision
